HomeMy WebLinkAbout09/08/1981 3epternber 8, 19t1 1 CITi COUNCIL MINUTE0 CIIt OF WHtAI RIDGE, COLOHAD0 The Study Session was called to order by the Mayor at 7 30 p m Councilmembers present Pat Aiello, Bill Bowman, Hary Jo Cavarra, Kent Davis, Ken Lewis, Larry Merkl, and Louise Turner City Clerk, Carol Hampf, City freasurer, Jim Malone, City Administrator, Tom Palmer, City Attorney, John Hayes, Depar tmell t deads Hugh Brown, Charles Stromberg, Rodger Young, staff, and interested citizens Discussed were 1) the creation of an Urban Renewal Authority and Status Report on the Wadsworth Town Center, and 2) Review of Council Bill 86 regarding Conditional Zoning and Site Plans Ihe Regular Session was called to order by the Mayor at 9 30 p m URDINANCE3 UN FIH3T rlEADING Item 1 Council Bill 3d - An Ordinance finding the existence of blighted areas within the City, and the need for the redevelopment and rehabilitation of said areas, declaring it to be in the public interest that an Urban Renewal Authority be organized, organziing and establishing the Wheat Ridge Urban Renewal Authority pursuant to State Statute, directing the Mayor to appoint Commissioners to serve on said Authority Hotion by i~r Merkl that Section 4 be changed to read that "the Hayor is hereby directed, pursuant to C R S 1973, 31-25-104, to appoint I commissioners to serve on the Wheat Ridge Urban Renewal Authority, and that one member be from each Council District and three be appointed at large", seconded by Mr Aiello, carried 5-1-and 1 abstaining Mrs Turner voted no and Mr Davis abstained, as he had previously stated that since he had property ownership in a portion of this area he would need to abstain, approved by Council Motion by Mr Merkl that Council Bill 88 be approved on first reading, ordered published, public hearing be set for Honday, September 28, 1981, at 7 30 p m in City Council Chambers, Municipal Building, and if approved on second reading, take effect 10 days after final publication, seconded by Mr Aiello, carried 4-2-1 abstention Mr Davis abstaining, Mr Lewis and Mrs Turner voting No Mrs Turner stated that she was voting no, because the Urban Renewal Area is not a blighted area DECISIUNS, RtSULUTIONS, AND MUfIONS I tern 2 Award of bid for 1981 Street Program Hr Young reviewed the street bid Amended Motion that we accept the six bids submi tted for the 1981 Street Improvement Program Proj ect, PW 81-2, and award the contract to Brannan Sand and Gravel Co for the amount of their bid, $656,596 53, plus a 10% contingency of $65,659 47 and authorize the Director of Public Works to sign any Change Order to the Contract up to the funds appropriated herein, with the amendment that the Director of Public Works arrange that the replacement of curb, gutter, and sidewalk be done on a 50/50 basis with the City and the homeowner sharing the cost He further moved that $222,256 be transferred from Account 31-302-800-833 to Account 31-303-800-840 to cover the cost of the additional streets added to the program as approved on May 4, 1981 Original Motion by Mr Davis, seconded by Mr Aiello, Amending Motion by Mr Bowman, seconded by Mr Lewis, Amendment carried 6-1 with Mrs Turner voting No The Motion as amended carried 0-1, with Mrs Turner voting No Mrs Turner stated that she was opposed to the City replacing or doing any curb, gutter, and sidewalk at City expense Item 3 Transfer of ownership for Booze N'Beans, Inc , dba Deserays, ~110 West 44th Avenue, to be known as Neros Nook New owner to be Arthur Knief Arthur Knief was present and sworn in Motion by Mrs Turner to approve the Transfer of Ownership and request for Chan~e of Name from Deseray's to Nero's Nook, located at 9110 West 44th Avenue, for applicant Arthur Knief, for a Class T - Tavern License with extended hours, seconded by Mr Davis, carried 7-0 CITY CUUNCIL MINUT~~ Septernber 8, 1l,J81 Page -2- Item 4 Special Events Permit for Sts Peter & Paul's Parish, 3jOU Pierce Street, 3 2io Beer License for October 3, lY81 hadge McCreeoy, 5881 Ellis Lt , Arvada, and Chris 0arcia, 74~U ~ 43th Circle, Wheat Ridge, were present and sworn in Motion by Mr Aiello, that the ~pecial Events Permit for Sts Peter & Paul's Parish, to dispense 3 2% beer on October 3, lYdl, between the hours of 11 00 a en and 7 00 pen, at 3jUU Pierce Street, in the gyrn, and that no beer be taken frorn the licensed area, and the licensed area be restricted to the sale and conswnption of beer, secondej by t~r tlJerkl, carried 7-0 Item J --- Resolution 739 - Authorizing the Jefferson County Open Space Ufficials to secure professional appraisal on the Byerly Property located at West 2l,Jth and Newland Streets in Wheat Ridge, Colorado ~otion by Mr Merkl to approve Resolution 739 and further move that staff get an estimate of the cost to raze and clear the site, cost to develop the site into a family park, and submit to Council a drawing showing exactly what property is being appraised, seconded by Mr Lewis, carr ied 4-3, \,i th Counc ilmember s Aiello, Bowman, and Dav is voting No Mr Aiello stating that he cannot vote for appraisal without a plan or survey to know exactly what we are appraising ~OUNCIL COMMITTE3' AND COMMISSIONS' MATTER~ Item 6 Motion by Mrs Cavarra to reappoint Carol Hampf to the Colorado Municipal League Policy Committee, seconded by Mr Davis, carried 7-0 Meeting was adjourned at 10 25 P m APPROVElJ car CFH,
