HomeMy WebLinkAbout09/14/1981 September 14, 1981 CITY COUNCIL MINUTES CITY OF WHEAT RIDGE, COLORADO The City Council meeting was called to order by the Mayor at 7 30 p m Councilmembers present Pat Aiello, bill Bowman, Mary Jo Cavarra, Kent Davis, Ken Lewis, Larry MerKl, and Louise Turner Also present City Clerk, Carol Hampf, City Administrator, Tom Palmer, City Attorney, John Hayes, Department Heads Hugh Brown and Charles Stromberg, staff, and interested citizens Motion by Mr Merkl to approve the Minutes of 8/24 and 9/8/1981, seconded by Mr Davis, carried 7-0 PRESENTATION OF SERVICE AWARD PLAQUES by the Mayor to Doug Gildner, Board of Adjustment, anj John Hardaway, Mass Transit Committee PUBLIC COMMENT Vivian Waterman, representing the Fairmount Community, whose boundaries are to the south Clear Creek and to the east Eldridge, spoke in opposition to the Adult Book Store and wished that it be closed down Mr Hayes stated that this is also the City's wish, that any action taken be deferred until it can be a final action and not just a temporary restraining order It was requested by Council that an emergency ordinance be brought in to the September 28 meeting, as well as an agenda item for the discussion of a moratorium on arcade licenses Karen Watson, 3390 Garrison Street, thanked Council and staff for their efforts in having the small house near Everitt Junior High, that has been in disrepair, torn down PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 1 Council Bill 71 - An Ordinance providing for the approval of rezoning from Residential-One (R-1) and Commercial-One (C-1) to Planned Commercial Development (PCD) and approval of an Outline Development Plan for land located at approximately the southeast corner of Kipling Street and West 38th Avenue, City of Wheat Ridge, County of Jefferson, State of Colorado (Charles Einarsen) (Case No WZ-81-2) (Appeal from Planning Commission Denial) Mr George HOlley, attorney for the applicant, asked if a legal protest had been filed and in order Mr Hayes said that this was true Mr Holley then requested a continuance of the case until all 8 Councilmembers would be present, since 6 affirmative votes would be required to pass the Ordinance Mrs Cavarra stated that she would rather not delay the hearing as Council had reserved this evening for said hearing, and the applicant had requested a continuance once before She therefore moved that the request be denied and the hearing be held this evening, seconded by Mrs Turner, failed 2-5, with Councilmembers Merkl, Bowman, Davis, Lewis, and Aiello voting No Motion by Mr Aiello to suspend the Council Rules of Procedure and that this hearing be continued until October 12, 1981, seconded by Mr Davis, carried 7-0 ORDINANCES ON FIRST READING Item 2 Council Bill 89 - An Ordinance repealing Ordinance 454, adopted by the Wheat Ridge City Council on May 11, 1981, repealing Sections 8-1, 8-5, 8-6 and 8-7 and reenacting Sections 8-1 and 8-5 of the Code of Laws of the City of Wheat Ridge, adopting by reference the Uniform Fire Code, 1979 Edition, copyright 1979, providing for certain amendments thereto, and providing penalties for violation thereof Ordinance was introduced on first reading by Mr Lewis, title read by the Clerk Motion by Mr Lewis that Council Bill 89 be approved on first reading ordered published, public hearing be set for Monday, October 26, 1~81, at 7 30 p m in City Council Chambers, Municipal Building, and if approved on second reading, ta~e effect 1 day after final publication, seconded by Mr Bowman, carrled 7-0 CITY COUNCIL MINUTES September 14, 1981 Page -2- DECISIONS, RESOLUTIONS, AND MOTIONS Item L Award of bid for Street Repair Materials Motion oy Mr Aiello that we purchase 48,000 gallons of Cationic Emulsified Asphalt, from Asphalt Supply and Service Inc , at a total cost of $40,800 00, and we purchase 3,000 tons of cover aggregate, from Asphalt Paving, at a total cost of $35,700 00, to be charged to account No 31-303-800-833, seconded by Mr Merkl, carried 7-0 CITY ATTORNEi'S MATTERS Mr Hayes reminded Council that there had been a request to see if we were interested in our Municipal Court being included in the Judicial Poll It was stated that Judge Zarlengo would be in favor of this Council agreed COUNCILMEMBERS MATTERS Mr Davis enquired as to the striping of the streets and was informed it is being done and will be continued Mr Lewis asked about additional parking at Randall Park and asked the Park's Commission to look into it He also commented that in Golden the traffic signals are placed on flashing red and yellow after 10 00 P m on other than the main streets, and asked staff to look into the possibility of Wheat Ridge doing this Mr Aiello asked regarding the third budget study session meeting It was determined that this be held between 6 and 7 30 p m on Wednesday, September 23, 1981 Mrs Turner asked if the median being constructed on Wadsworth near Johnson Park could be landscaped with bushes instead of concreted Voting delegates to the National League of Cities Conference are Mr Davis and the alternate Mr Bowman Meeting was adjourned at 9 00 p m --'. ~-.-::--- / ,/ / /;~- c" /-L / / /1 ~-1? ~;t;Y Carol F -
