HomeMy WebLinkAbout03/08/1982 CITY OF ,JtlEAT RIDGE, COLORADu ClfY COUNCIL MINUTES !i~!:..<:.~8, 1982 The City Council Meeting was called to order by the Mayor at 7 30 p ~ Councilme~bers present Pat Aiello, Will Burt, Kent Davis, Clyde E Hobbs, Larry Merkl, Kay Ore, and tJancy Snow Also present City Clerk, Carol Harnpf, City Treasurer, James ~lalone, City Administrator, TOrn Palmer, City Attorney, John Yayes, Department Heads Hu~h Brown, Ed Pinson, Charles Stromber~, and Rodger Young, staff, and interested citizens Motion by Mr Davis for approval of the Minutes of February 22, 1982 as printed, seconded by Mrs Ore, carried 7-0 PUBLIC COH~1EiH Clement D Bisant, 2980 Newland 3treet, presented a petition opposing enlarging Hank Stites Park Edgar Johnson, 3{00 Benton Street, representing the Parks Commission, spoke regarding the Wheat Ridge Town Center Park, that the Commission is not opposed to a park, but if Open Space funds are used, they feel Open Space should be reinbursed later, and also spoke as a citizen regarding the traffic pattern at 38th & Denton & Ames, that it is still dangerous Mrs Ore read a letter that had been received addressed to Wheat Ridge City Council fron N Evelyn Roberts, thanking those people on City l,ouncil who had voted in favor of the Industrial Revenue Bonds for King Soopers, since we now nave the new store OFfICER OF THE YEAH AWARD was not presented since the officer was not present to receive it Chief Edward Pinson was presented with a Resolution, of appreciation upon his retirenent as Chief of Police PUBLIC HEARINGS AND ORDINANCES O~ SECOND READING Item 1 Application by United Presbyterian Association for approval of a combined Preliminary and Final Development Plan and Plat on property at approximately 6330 W 38th Ave (WZ-81-28) i'ir Stromberg gave the staff report and entered the documents into the record He presented Exhibit A, which was a new page 4 of the plat, received today, which now includes the drainage easement and the no parking areas as requested by Planning Commission Proponents and applicants present were sworn in as follows Edgar Johnson, 37JO Benton Street, Jerry Monroe, 2020 Stacy Drive, Denver, Rose Franklin, 3057 Ames Street, Denver, John H IJamil ton, of Sellard f, Griff Consulting Engineers, 8745 W 14th Avenue, (drainage), Sister Mary Clare Gilligan, 4040 Pierce Street, Ron Richards, 11931 vi 70th ,~ay, Arvada, Jane Harrington, 500 E 8th Ave, Denver, (Colorada Housing Authority), Charles F Jones, 4560 Allison Street, and Dennis Boggio, 7801 E Delleview, Englewood There was no one present to speak in opposition Motion by Mr rlerkl that Case Wl-Bl-28, a request for approval of a Combined Final Development Plan and Plat for the llighland South Planned Residential Development, be approved for the following reasons and with the following conditions All notification requirements have been met, all requirements of the Zoning Ordinance and Subdivision Regulations have been met, or will be met prior to recording, the final plan and plat is consistent with the approved Outline Development Plan, Planning Cornmission has recomnended approval, and the drainage plan from Sellard & Griff has been accepted and approved by the City Engineer Conditions The parkland dedication and fees in lieu are waived in consideration of the proposed park which is to be open to the public for perpetual use but maintained by the applicant, all ~inor technical corrections and additions as required by the Zoning Ordinance and Subdivision Regulations shall be made prior to recording, location of fire hydrants shall be added to the plan, and approved by the Fire Department, prior to recorjing, and that the age requirements shall show a minimum of 62 years, seconded by ivJr Aiello, carried 7-0 CITY COuNCIL MINUTES Item 2 "larch 3, 1 '332 Page -2- Application by Kenneth Frens for approval of a Special use Permit for a body shop located at approximately 4735 Kipling ~treet (SUP-d1-10) Itern 2 was withdrawn, it is to be heard ~larch 22, 1':!82 I tell! 3 --- Application by Randy Currier for a foree-lot Minor ~ubvision on property located at 4020 and 4034 Aadsworth Blvd (;1S-82-1 ) Applicant requested an indefinite continuance continue Item 3 indefinitely, seconded by Mrs Item 4 Motion by Mr Merkl to Ore, carried 1-0 Application by Roy Ferguson for ~ubdivi3ion on property located Avenue, W~eat Ridge, Colorado froln FeD 8, 1982) approval of a Two-lot Minor approximately 9551 West 3Sth (Case No 13-80-2) (Continued Mr Stromberg gave the staff report and entered the documents into the record Hr Fox represented the applicant, Roy Ferguson He stated that a drainage report nas been received and approved and that all requirements have been met Opponents sworn in and spoke were Harth a Combs, 3850 Independence Court, Margaret Graff, 9550 W 3':!th Ave ~ Jim Burke, 3825 Hoyt, Mark Graff, 9550.J 39th Ave , and Horace Steen, 9505 d 38th Avenue They were concerned about draina~e, fire safetf, and the continued maintenance of the drive Mr Burke presented a petition in opposition that stated that if their concerns were taken care of they would not be opposed to Mr Ferguson developing his property Following concerns about the dedication or easement of the private drive, Motion by l'lr Hobbs to continue this for 2 weeks, seconded by Hrs Ore,carried 5-2 with Hr Aiello and Mrs Snow voting No Motion at 11 00 p m by Mrs Ore to suspend the Rules and to complete the Agenda in total, seconded by Mr Merkl, carried 4-3 with Mr Davis, Mr Burt, and Hr Aiello voting No Item 5 Council Bill No 9 - An Ordinance repealing and reenacting Section 21-21 and Section 21-23 of Chapter 21, Article II of the Code of the City of ~heat Ridge, Colorado, pertaining to Taxation of Telephone Exchanges (Continued from February 8, 1982) Ordinance was introduced on second reading by 1r Merkl Motion by Hr Merkl for the adoption of Council Bill:! (Ordinance 487) on second reading and order it published, seconded by 1rs ure, carried 7-0 Item 6 ORDINANCES ON FIRST READING Council Bill 14 - An Ordinance amending the Code of Laws of the City of dheat Ridge, Colorado, by repealing and reenacting Section 4-9, Exotic, Dangerous and Unusual Animals, and providing a penalty for a violation thereof Ordinance was introduced on first reading by Mr Davis, title read by the Clerk Motion by Mr Davis that Council Bill 14 be approved on first reading, ordered publisned, public hearing be set for Monday, March 22, 1982 at 7 30 p m in City Council Chambers, Municipal Building, and if approved on second reading, take effect 15 days after final publication, seconded oy Mr Burt, carried 6-1 with Mrs Ore voting 1~0 Item 7 Council Bill 11 - Amending Resolution No 745 adopting salary schedule and providing pay grades and pay ranges for fiscal year 1982 (Department Heads) Motion by Mrs Ore for the adoption of Resolution No 776, seconded by Mr Burt, failed 2-5 with Councilmembers Davis, Hobbs, Merkl, Aiello, and Snow voting No Proposed Motion by Mrs Snow, that if tne City Ad~inistrator finds an outstanding candidate for Police Chief and cannot hire him for salary reasons, that he may come back to City Council Received no second COUNCIL MEMBERS MATTERS Item 12 Motion by Mrs Ore to hold a Study Session March 15, 1982 regarding departmental reorganization, seconded by Mr Hobbs, carried 6-1, with Mr Davis voting No Item 13 Motion by Mrs Ore to hold City Council Study Sessions March 19 (evening) and 20 with Lyle Surnek on goals and objectives, seconded by Mr Aiello, carried 7-0 Item 14 Joint venture with Lakewood and Jefferson County on 29th Motion by Mrs Snow to request Public Works to work on it (the street problem at 29tn east of Youngfield) and come back to City Council with recommendation of \vt1at to do, seconded by Mr Merkl, carried 7-0 Item_~ Clarification of Zoning Ordinance re foster homes Motion by Mrs seconded by '1r Snow for Mr Hayes to draft and bring in an Ordinance, Aiello, carried 7-0 Motion by Mr Aiello to suspend the Rules in order to make an appointment to the Arborist Board, seconded by Mr Merkl, carried 7-0 Motion by Mr Aiello to appoint Mr Pat Lovelace, 3550 Chase Street, to the Arborist Board (he had been recornrnended by the Wheat Ridge Men's Garden Club), seconded by Mr Merkl, carried 7-0 Motion by Mr Hobbs th8t the Air Pollution Study Committee be formed and implemented inmediately to consist of Mr Merkl, Mr Lewis, Mr Burt, and Mr Hobbs (Mr Hobbs to be the chairman), seconded by Mrs Ore, carried 7-0 11eeting 3djourned at 11 40 p m ~'~^'J ') 1 ~~ -
