HomeMy WebLinkAbout04/26/1982 - CITr COUNCIL MINUTES CITY OF dHEAT RIDGE, COLORADO April 26, 1982 The City Council Meeting was called to order by the Mayor at 7 30 p m Councilmembers present Pat Aiello, Will Burt, Kent Davis, Clyde E Hobbs, Ken Lewis, Larry Merkl, Kay Ore, and Nancy Snow Also present City Clerk, Carol Hampf, City Administrator, Tom Palmer, Acting City Attorney, Lee Phillips, City Treasurer, Jim Malone, Department Heads Richard Bredt, Acting Chief Jaquay, Rodger Young, staff, interested ci tizens f~otion by Mr Davis to approve the Minutes of April 12, 1982, seconded by Mrs Snow, carried 8-0 PUBLIC CO~H1ENT Jill Reasoner, 437J Pierson St , Louis Weltzer, 4625 Teller St , Andy Beck, 4675 Teller St , Larry Barnett, 425J Parfet St (he owns 46~ Teller), Nick Hazen, 1j645 Teller, and Roger Jean, 4645 Teller St , all spoke in opposition to the Teller Street project, which would widen Teller Street between 46th Place and 48th Avenue to match the street north and south of that area Mr Palmer will report back to City Council on this project PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 1 Council Bill 14 - An Ordinance amending the Code of Laws of the City of wheat Ridge, Colorado, by repealing and reenacting Section 4-9, Exotic, Dangerous and Unusual Animals, and providing a penalty for a violation thereof (With Amendments from Animal Control Commission as requested by Council) Council Bill 14 was introduced on second reading by Mr Davis, title read by the Clerk Dr Robert Hilsenroth of the Animal Control Commission stated that he felt the bill was okay and that the amendments were okay Mrs Snow asked that honey bees be included Motion by Mr Davis to approve Council Bill 14 (Ordinance 491) as amended by adding the fOllowing (c) Definitions Exotic - "Not indigenous, foreign" Animal Control Commissions's interpretation Any animal that is "exotic" is one not normally found in Wheat Ridge That doesn't imply that the animal must exist in the wild in Wheat Ridge to not be considered exotic, e g , there are lots of parakets in the city, but they are not native wild - "Occuring, growing, or living in a natural state, not domesticated, cultivated or tamed" Domesticated - "Adapted to human living conditions and practical uses, tame" (d) Domestic Animals Aquarium Fishes Psitocine Birds, Aviary Finches etc, Farm Birds - (Ducks, Geese, Swans, Poultry) Domestic Rabbit (Oryctolagus Coniculus) Mongolian Gerbil (Meriones Unguicularus) Guinea Pig (Cavia Porceilus) Hamster (Mesorcricetus Auratus) Domestic Laboratory Mouse (Mus Domesticus) Domestic Laboratory Rat (Rattus Rattus Albino Strain) Domestic Cat (Felis Catus) Domestic Dog (Canis Familiaris) Domestic Livestock including but not limited to Horses, cattle, sheep, goats, swine, mules, donkeys, burros, llamas, honey bees CITY COUNCI IIN UTES Ilpril 26, 1982 Page -2- Exotic and Wild Animals Every other creature within the Animal Kingdom (e) Owners of any animals prohibited under the provisions of this ordinance have sixty (60) days from final publication of this ordinance to bring themselves into compliance therewith, or to receive an exception from the Animal Control Commission as specified in Section 4-9 (b) Seconded by Mr Aiello, carried 8-0 Item 2 ORDINANCES ON FIRST READING Council Bill 16 - An Ordinance amending Chapter 21A, Television Cable Systems, of the Code of Laws of the City of wheat Ridge, by amending Sections 21A-9(c), System Service and Extension, and Section 21A-22, Property Damage Fund, thereof, and by adding a Section 21A-27 5, Permit Review Council Bill 16 was introduced on first reading by Mr Aiello, title read by the Clerk Motion by Mr Aiello that Council Bill 16 be approved on first reading, ordered published, public hearing be set for Honday, May 10, 1982 at '730 p m in City Council Chambers, Municipal Building, and if approved on second reading, take effect 1 day after final publication with the following amendments that Section 2 (b) add "within 14 days in writing", 3ection 3 the last sentence be changed to read "In any event a review shall be made two years before the termination date of any permi t issued hereunder" Seconded by t1r Burt, carried 8-0 Item 3 Council Bill 17 - An Ordinance ratifying leases of Real Property between the Adolph Coors Company and the City of Wheat Ridge to be utilized by the City of Wheat Ridge for Park and Open Space purposes Council Bill 17 was introduced on first reading by Mrs Snow, title read by the Clerk Motion by Mrs Snow that Council Bill 17 be approved on first reading, ordered published, public hearing be set for Monday, May 10,1982 at 7 30 p m in City Council Chambers, t1unicipal Building, and if approved on second reading, take effect 1 day after final publication, seconded by Mr Davis, carried 8-0 Item 4 Council Bill 18 - An Ordinance vacating a portion of Kline Street located South of West 44th Avenue within the City of Aheat Ridge, Colorado, as more fully described herein (Case No WV-82-1) Council Bill 18 was introduced on first reading by Mr Merkl, title read by the Clerk Motion by Mr Merkl that Council Bill 18 be approved on first reading, ordered published, public hearing be set for Monday, May 24, 1982 at 7 30 p m in City Council Chambers, Municipal Building, and if approved on second reading, take effect 1 day after final publ ica tion Item 5 Council Bill 19 - An Ordinance providing for the approval of a Rezoning from Commercial-One (C-1) and Agricultural-One (A-1) to Commercial-One (C-1) for land located at approximately 10930 W 44th Avenue, City of Wheat Ridge, County of Jefferson, State of Colorado (1st Bank of Wheat Ridge) (Case No tlZ-82-1) Council Bill 19 was introduced on first reading by Mr Aiello, title read by the Clerk Motion by Mr Aiello that Council Bill 19 be approved on first reading, ordered published, public hearing be set for Monday, May 24, 1982 at 7 30 p m in City Council Chambers, Municipal Building, and if approved on second reading, take effect 15 days after final publication, seconded by Mr Merkl, carried 8-0 I telTI 6 DECISIUNS, RESOLUTIONS, AND MOTIONS Financial Statement and Auditors Report for year ended December 31, 1981 Jim Malone introduced Donald Bruner, Accountant of Weiss, Carr, and Grienler, who stated that he felt the City s financial records were in excellent condition Motion by Mr Davis for the approval of th~ financial statement and auditors report for the fear ended Decem er 1981, seconded by Mrs Ore, carried 3-0 31 , CITY COUNCIL-MINUnS April 26, 1'182 Page -3- Item 7 -- Team and Consultants Report and Recommendation for Cable Permit and Award Mr Aiello stated that American Cablevision Inc was the unanimous selection and recommendation of the Team and Consultants Russ Sindt and Bob Austin, Cab I e Consul tan ts, 1485 Holl and, Lakewood, gave some background on how the choice was made Mark Hogan of Colorado Cablevision, Inc , 672 Clarkson, Denver, spoke in favor of his company Scott Greenhill of American Cablevision, 1891 S t1adison, Denver, stated they were gratified to be selected by the review team James Wilson, 3705 Upham, Wheat Ridge, Richard hranzler, 4095 Dudley, Wheat Ridge, and Mary Jo Cavarra, 3805 Robb Street, Wheat Ridge, spoke favoring Colorado Cablevision John Jerman, 11694 W 37th Ave, Wheat Ridge, of Community Tele-Communications, Inc , spoke regarding some of the problems he found with the team's report and favoring his company Marilyn Fincken, 112147 0 69th Ave, Arvada, asked Council to consider the Jeffco Adult Education, that there are many people who would like these classes on Cable Television Following discussion and questions of the companies present, Motion by Mr Aiello that City Council accept the report from the Cable Television Review Team and recommend that the Council put on the ballot for June 22, 1982 the American Cablevision of Wheat Ridge as the company selected by the Wheat Ridge City Council, seconded by Mr Burt Motion by Mr Lewis that this be continued until May 10, 1982 and the full Council have an opportunity to meet with the team and consultants to resolve our questions, a special study session to be held May 6,1982, seconded by Mr Davis, carried 5-3, with Councilmembers Burt, Merkl, and Aiello voting No Item 8 Consent Agenda A Resolution 784 - in support of Jeffco Action Center \~alkathon B Accept Deed from Victor N Prehn and Joel V Prehn, 5630 vV 38th Ave , for Right-of-Way C Accept Deed from Victor N Prehn and Joel V Prehn and Helena S Prehn, 3701 Depew Street, for Right-of-Way D A~Jard of Bid for concrete and plastic pipe E Cancel May 3, 1982 Study Session (Caucus Night) Motion by Mr Burt for the adoption of the Consent Agenda in its entirety, seconded by Mr Davis, carried 7-1 with Mr Lewis voting No Item 9 Motion by Mr Davis we rescind the previous motion, made on April 12, 1982 awarding the well drilling contract to Norman Hill Drilling Co and move we contract with Layne Western Co Inc , to drill one Arapahoe Aquifer well in Hayward Park, at a total cost of $36,790, to be charged to account No 31-603-862 seconded by Mrs Ore, carried 7-1 with Mr Lewis voting No Item 10 Award of Bid for 800 MHz Radio System including Antenna Tower and Resolution 785 transferring $18,000 within the Annual Budget to complete the project Motion by Mr Merkl that we purchase the Radio System from TACTEC and the tower from GRB, erect the antenna tO~Jer at the Municipal Building site, apply for variance in height for the tower and that the Mayor sign the application for the varial'lce from the Board of Adjustment for the tower and recommend their approval, and $50,000 be charged to Account No 19-301-805 and $18,000 be charged to Account No 01-301-805, totalling $68,000 for the system I further move Resolution 785 be approved for the transfer of funds, seconded by I-Irs Ore, carried 7-1 with Mr Lewis voting No Meeting adjourned at 11 05 p m C( ~~[rcd'" Carol F Hampf, CFH, chj, 1 erk
