The City Council Meeting was called to order by the Mayor at 7 30 p m
Councilmembers present Pat Aiello, Will Burt, Kent Davis, Clyde E
Hobbs, hen Lewis, Larry Merkl, Kay Ore, and Nancy Snow Also present
City ClerK, Carol Harnpf, City Treasurer, James Malone, City
Administrator, Tom Palmer, City Attorney, John Hayes, Department Heads
Richard Bredt, Chief Jaquay, Charles Stromberg, and Rodger Young, staff,
and interested citizens
Motion by Mr Aiello for the approval 01 the Minutes of June
seconded by j'ir Davis, carried 6 in favor, 2 abstaining, Mr
Mrs Ore, because they had not been present at that meeting

CITIZENS' HIGHT TO SPEAK
Mrs Ore commended the Police Department for the way they handled the
serious traffic accident last weekend
franK Wooten, 3100 Ames Street, stated that he had called the Police
Department several times regarding noise in the neighborhood and
subsequently received a ticket for making a false statement and wants to
know what City Council is going to do about it
Albert Perry, 3645 Hiller Street, spoke regarding daliJage to rlls hOiile
which he feels was caused by the traffic during the detour of1 of 38th
during the Lena Gulch project He had contacted the City's insurance
company and was turned down Mr Hayes suggested that the appropriate
person to contact would be the contractor's insurance company

Staff report was presented by Mr Stromberg The applicant was not
present at this time Present for the opposition and sworn in were
Robert Hartung, 5925 W 39th Place, Bob Carson, 14022 W 22nd Ave, and
John Peterson, 3990 Independence Ct They spoke re~arding problems they
could foresee, especially if "junk cars" were stored on the property
Applicant Lloyd Kiper, ':;,6'70 Lamar Street, was nOh' present and stated
that they would screen the areas where outside stored cars would be
placed, and they would be cars to be repaired Motion by Mrs Ore that
Council Bill 23 (Ordinance 4913), a request by Lloyd Kiper for approval
of a Special Use Permit to allow the operation of a garage for the
repair and servicing of motor vehicles entirely within an enclosed
building at 4949 Marshall Street, be approved for the following reasons
a) staff recommends approval, b) Planning l,ommission recommends
approval, and c) the request is compatible with the surrounding land
uses, with the following conditions that Section 2 Number 3 of the
present urdinance be adhered to and that is "A b foot screening fence
shall be constructed to conceal all outside storage including vehicles
in the state of repair" and that the proposed site plan submitted to
Council with this request be followed as closely as possible, seconded
by Mr Aiello, carried 7-1 with Mr Davis voting No

Building Permit as required by the Wheat Ridge Comprehensive
Plan -dadsworth Town Center Master Plan, and by the adopted
Wheat Ridge Urban Renewal Plan for the Wadsworth Town Center-
Limited Project - 3950 ~adsworth Blvd
(Case No WSP-82-1, Donna Dunaway)
Mr Stromberg gave the staff report Applicant Donna Dunaway, 3706
Dartmouth, Dallas, Texas, was present There was no one in opposition
~otion by Mr Aiello that Case No WSP-82-1 be approved with the
following condition3 1 Only those parking spaces needed for the
proposed new structure shall be required, 2 the ingress/egress easement
along the east boundary shall be paved with at least 24 feet of pavement
width, 3 there shall be at least a 20 ft wide access drive along the
north side of the proposed structure, 4 all landscape requirements of
the zoning ordinance shall be met, which includes at least grass on the
unpaved portion shown on the plan, seconded by Mr Burt, carried 4 in
favor,.5 in opposition, !VIr r~erkl, 1'1rs Ore, and Hrs Snow, and 1
abstaining, t1r Davis for the reasons previously given Hr [1erkl
stated he was voting No because you cannot put an office in a shopping
center Mrs Snow stating No because she felt it was an exercise in
futility - the years spent working for a shopping center if office
buildings are included Failed Motion by Mrs Snow that the building
contain only retail and service retail uses, seconded by Mr Merkl,
failed 3 in favor, 4 opposed, Mr Burt, Mr Hobbs, Mr Lewis, and Mr
Aiello, and Mr Davis abstaining

Council Bill 24 - Providing for approval of a Special Use
Permi t in a Commerc ial-One (C-1) zone, 12351 W 44th Ave
(Case No SUP-81-9, Petroleum Wholesale) (An Appeal from
Planning Commission Denial)
Ordinance was introduced on second reading, title read by the Clerk
Mr Stromberg gave the staff report Those present for the applicant
were Gerald Boatright, attorney, 4315 Wadsworth Blvd, Joel Gunnels,
730 G Street, Golden, Phil Scott, of Lee, Scott, Cleary, Inc , traffic
engineers, 615 Downing Street, Denver, Rich Osborn, representing
Petroleum Wholesale, Inc ,7314 17Ul Street, Humble, Texas Phil Scott
spoke and showed graphics of the plans they have to improve the traffic
pattern Hich Osborn, Vice President of Petroleum Wholesale, said that
the company would make those street improvements and pay for them
Those present in opposition and sworn in were Janice Thompson, 12290
~ 42nd Ave, Mabel Ryan, 4365 Vivian, Bertha Roberts, 43~5 Vivian, Bob
Barr, operator of the Union Truck Stop, 44th & Ward Road, Dennis DickOf
Evergreen, Colorado, whose concerns were the amount of parking remaining
at Port 44, there are already 2 convenience stores in the area, that 3
auto service stations in the area have recently been closed, and the
area needs to be redeveloped, and when consideration is made for the
area, the whole area needs to be considered Motion by Mrs Ore that
Council Bill 24 be denied for the following reasons Planning
Commission and staff recommended denial, the State Highway Department
and Arvada Fire Department are concerned that this use will create
additional traffic congestion and concerned whether the turning
movements of large trucks from this site can safey occur We concur
with these concerns

The applicant has not addressed the potential future impacts of other
development in the general vicinity including that from the balance of
his own property, the proposed use would add considerably to the air
pollution and noise in the area, the proposed use would further
interfere with residents' access to their hOttles south of the subject
parcel, the proposed street modifications woulo further restr ict traffic
flow rather than improve it, and other viable uses exist for this
property which would not necessarily cause the traffic impacts of this
proposal, seconded by Mrs Jnow, carried 7-1 witn Mr Lewis voting No

Motion by Mr Lewis that we approve DHCOG's request as per the written
memo by Tom Barnhart, second eo by Mr Davis, carried 7-1, Mrs Snow
voting No
Motion by Mr Merkl that we continue this meeting for 1 hour to finish
the agenda, seconded by Mr Aiello, failed 4-4 with Councilmernbers
Hobbs, Lewis, Davis, and Burt voting No Chair declared that we
continue on with the meeting

Proposal for Intergovernmental Agreement between Arvada and
Wheat Ridge for shared common boundary street maintenance
Motion by Mr Merkl to move for the adoption of Item 7 as asked by the
staff, seconded by Mrs Ore, carried 8-0

Proposal from Jefferson County COltlmissioners for Wheat Ridge
annexation and receipt of deed for 1/2 of Independence, 51st
Street to 50th Street
Motion by Mrs Ore that we accept the deed and annexation proposals and
start the procedure including amending the boundaries of the City to
reflect the additional deed and have it corrected by District Court,
seconded by Mr Burt, carried 8-0

Motion by Mrs Ore that Case No DP-82-2, a request to dump 40,000 cubic
yards of fill be approved for the following reasons and conditions a)
staff recommends approval, b) there have been no negative referrals, c)
there are no adverse impacts to adjacent properties, d) proper bank
stabilization be instituted by tne contractor meeting Public Works
approval, seconded by Mr Aiello, failed 4-4 with Councilmembers Davis,
Hobbs, Merkl, and Lewis voting No, since the dirt had been dumped prior
to the permit application Motion by Mr Davis to reconsider, seconded
by Mrs Snow, carried 5-3, with Councilmembers Hobbs, Merkl, and Lewis

The case will be heard in District Court in December
2 The Trainor case that was filed against the City is a challenge to
the affirmation of Ordinance 98
3 Mr Hayes requested if Council wishes to go to District Court
regarding the Colorado Roses property at 3705 Jay, the verbal bids to
have the property cleaned up were $87,000 and $91,000 and the Randy
Stone property, a building was built in violation, City had won the case
in Court but the building still stands Both owners say if we want it
removed we can do it and bill them through District Court Council
requested that this be brought in on July 26

Motion by Mrs Ore that Carol Hampf obtain outside attorney for the
purpose of the Charter Amendment initiative proceedings and further move
that money be transferred from the unallocated funds to cover the cost,
