HomeMy WebLinkAbout11/21/1983 CITY -OF WHEAT RIDGE - MEMORANDUM To City Council, Mayor, City Administrat~ City Attorney, City Clerk Subject Agenda Item 7 C) Date From Kent Davis November 21, 1983 Approved Date Re Item 7 C ) I would request that this statement be included as part of the permanent record of this meeting, for any further reference if needed 1) In suspending the Rules of Council we are suspendinq two different and far-reaching problems a) The time element for reconsideration - In the past nIl reconsiderations would be considered during the following meeting - if we suspend the Rules we would establish indefinite times for reconsideration b) Who can reconsider - In the past those Councilmembers voting on the prevailing side could call for reconsideration According to this anyone could call for reconsioeration c) Refer to these later 2) I personally feel this item for reconsideration is based on one piece of property locnted within the area of 35th and 38th Marshall Street to Jay Street Since the Majority of this area is, and has been developed, let's call a spade a spade and define the property in question -3705 Jay, 5 24 acres owned presently by my family, and I therefore feel that this item (for reconsideration) is not for the benefit of the City, but a personal problem based on the following a) Ilemo dated 11/21/83 - l-1rs Snow "Several new and old Councilmembers expressed opinions that the change in the Comprehensive Plan was not in keeping with their wishes or the wishes of their constituents" I have personally contacted the "olcl Councilmembers", other than ~1rs Snow, and they have not indicated that concern to me The new CouncilmeMbers. if holdinq to their statpments, that they would wory with the present Council and the citizens, have not contacteo me, my family, or the Real Estate agent presently handling the sale of this property b) The property is and has been zoned as follows R-2 Under this zoninq a developer would still have for any change Be it all R-3 or PRD, Council still The same developer could develop this property as it Planning Commission's okay or Council's oyay 7./3 R-3 and 1/3 to come before council will have control stands without c) The original chanqe was initiated by the Planninq Commission Therefore any reconsideration should he referred back to the Commission Finally and in Conclusion If this Council votes for this change, where will it end? All decisions made by the past Councilor Councils can be changed at will The decisions of this Council can be changed by the next Council, and so on and so on and
