CITY COUNCIL MINUTES
CITY OF WHEAT RIDGE, COLORADO
The City Council Meeting was called to order by the Mayor at 7 30 p m
Councilrnembers present Kent Davis, Larry ~leryl, rloe Keller, Tony
Plasco, Nancy Snow, Randy West, and Dan Wilde Clyde Hobbs arrived at
7 32 P m Also present City Clerk, Wanda Sang; City Administrator,
Tom Palmer; City Attorney, John Hayes Chief of Police, H Jaquay;
nirector of Community Development, Charles Stromberg; Director of Parks,
Richard Bredt; staff and interested citizens
PROCLAMATIONS AND CEREMONIES
~1ayor Stites reao Resolution 895 - Appreciation to Charlotte Hill for
fourteen years of service to the City of Wheat Ridge and presented
plaque to Charlotte
CITIZENS' RIGHTS TO SPEAK
Ann Resler, 7440 W 34th Ave, asked Council's help to do something
about the rabbits adjacent to her property
Lloyd Resler, 275 E Girard, Englewood, owner of the 7440 W 34th
Avenue property, concurred with the above speaker
R.ick & Evelyn 11artin, 7375 vi 33rd Avenue, also concurred with the
above speakers and complained about the odor
Perry Wycoff, 7460 W
complained about the
rabbits

smell and suggested it could be cruel for the

City Attorney and staff felt the matter could be handled with the
ordinance regarding offensive odors
Charles Graul, Jr , 7955 W 42nd Avenue, discussed the partial
disappearance of Yarrow Street between 42nd and 44th Avenues
a problem with a fence that juts 3 feet out into the road at
end lIe feels this is a hazard ~lr Palmer stated he would
contact with Mr Graul regarding this matter

Item 1
Council Bill 130 - An Ordinance providing for the approval of a
Special Use Permit for six (6) semi-trailer and truck parkinq
spaces on property located at 4400 Ward Road, City of Wheat
Ridge, County of Jefferson, State of Colorado
(Harlis Tate) (Case No SUP-84-2)
Council Bill l30 was introduced on second reading by Mr Meryl title
read by the Clerk Mr Stromberg presented the case and read into the
record a letter from Public Storage, which is adjacent to the property
in question They fear damage to their property Sworn in by the Mayor
anrl speaking in favor of the Ordinance was Harlis Tate's partner,
Samuel F Keys of Port 44 He gave his reasons for wanting the 4
p~rking spaces dnd stateo that his business hao suffered since Public
Storage built on thp lot next to Port 44 Speakinq in opposition and
sworn in by the Nayor was LTanice Thompson, 12290 W 42nd Avenue She
questioned the business being there 10-12 years and stated there had
been a lot of traffic problems with Port 44 She had observed two
accidents causecl by trucks turning into Port 44 and questioned sanitary
facilities as trucks spend the night l'lr Keys spoke in rebuttal
Council asked questions and discussion followed l'lotion by l'lr rlerkl
for denial for the following reasons 1 ingress and egress to the site
is a hazard in this locatiun both as to semis using the property and
other traffic using Ward Road and causes traffic congestion upon
surrounding streets 2 Lack of permanent sanitary facilities and lack
uf 24 hour supervision on the site after the closing of the restaurant
are a hazard to the health, safety, and welfare of residents of the area
and would be incompatible with the surrounding area; seconded by 11rs
Snow carried 8-0

Council Bill l3l - An Ordinance vacating a portion of Miller
Court located south of West 38th Avenue within the City of
Wheat Ridge, Colorado, as more flllly described herein
(C'J.se No \'N-R3-4)
Council Rill 13l was introduced on second reading by Mrs Snow title
read by the Clerk Mr Stromherg presented the case Mr Merkl made a
point of order that Mrs Snow abstain from voting on this item as her
property is in the vicinity Mrs Snow replied that Mr Hayes approved
of her voting on this because it had nothing to do with her property
l'lr Hayes concurred r10tion b:1 Ilrs Snow that Council Bill 131
(Ordinance 573), d request for Vacation of a portion of Miller Court
located suuth of West 38th Avenue be approved subject to conditions
outlined in the Ordinance for the following reasons 1 There is
little or no impact upon surrounding land uses which are principCilly
City streets and the planned Lena Gulch drainageway 2 Since this
parcel is too small to be developed by itself, the land could not
provide for any public benefit, whereas vacating this parcel of land to
private oWllership could make the existing private property more valuable
for future development or redevelopment under existing zoning seconded
by Mrs Keller; carried 7-1 with Mr Hobbs voting No

Council Bill l32 - An Ordinance approving a lease/purrhase
arrangement between the City of Wheat Ridge and NCR for the
three year lease/purchase of computer equipment to be lltilized
by the City of Whent Ridge
Bill 132 was introduced on second reading by Mr West; title
the Clerk Motion by Mr West that Council Bill 132 (Ordinance
adopted on second readinCJ '3econded by ~lr lIobbs; carried 8-0
Item 4
DECISIONS, RESOLUTIONS, AND MOTIONS
Resolution 897 - approving the Intergoverllloental Agreement
between the City of Wheat Ridge and the Wheat Ridge Urhan
Renewal Authorit} to oct as the agent for the City of Wheat
Ridge in contractiny for, and performing various duties related
to ecunomic development for the total City which includes
possible annexation areas
Resolution 897 was introduced by Mr Merkl; title read by the Clerk
Motion by Mr Merkl to adopt Resolution 897; seconded by Mr Wilde
Discussion followed Mr Plasco stated he would vote no because he
doesn't think WRU1{A is the right vehicle for this They do not need the
extension of either authority or duties He feels the right vehicle lS
the Chamber of Corrunerce Coordinating Committee He believes in the
economic development bond but does not feel this is the riqht vehicle
Motion carried 7-1 with Mr FIasco voting No
Item 5
New information and discussion on chemical control of ayuatic
weeds
Ann Kampf presented new information on the chemicnl control of aquatir
weeds She introduced Phil Goebel, biologist with the Colorado Hildlife
Division, A610 W 89th Ave, Broomfield, and Torn Jackson, biologist
with US F'ish and \.'lildlife, 3S9() l31st Street, Broomfield, who gave
reasons and background on the use of 2,4-D chemical
~on Ewig, 3500 Benton, stated his reasons against the use of 2,4-0 In
lakes and varks
Lillian Fleming, 6363 W 29th Avenue, staterl she was seriously concerned
with the contamination of water anrl feels it is a reckless use of
chemicnls that could come in contact with drinking water Motion by Mr
West to reconsider this item seconded by Mrs Snow; Failed 4-4 with
Councilmembers Davis, FIasco, heller, and Wilde voting No
Item 6
Motion that the Mayor be authorized to sign the contract
between the Department uf Highways, Division of llighway Safety,
and the City of Wheat Rirlge, for Traffic Safety Grant
Chief Jaquay presented contract and answered Council's questions
Motion by Ilr Merkl for approval ,vi th the condition that when funding
ceases, three positions be removed by attrition; seconded by Mrs Snow
