COLORADO August 13. 1984 The City council Meeting was called to order by the Mayor at 7 30 P m Councilmembers present Kent Davis, Larry Merkl, Clyde E Hobbs, Moe Keller, Tony FIasco, Nancy Snow, Randy West, and Dan Wilde Also present City Clerk, v,anda Sang; Acting City Administrator, Howard Jaquay; Acting City Attorney, Lee Phillips; Director of Community Development, Charles Stromberg; staff; and interested citizens ~lotion by Mr by [vIr wilde; Davis for approval of Minutes of July 23, carried 8-0 1984; seconded PROCLAMATIONS OR CEREMONIES Presentation by Mayor Stites to Maurin Gorman from Colorado National Bank of Proclamation "Thumbs Up por Safety Month", August 1984 Motion by Mr Merkl for adoption of Resolution 903; seconded by Mr Wilde; carried 8-0 Presentation by Mayor Stites of Resolution 903 - Resolution of Appreciation to Edward J Queen for thirteen years of service to the City of Wheat Ridge CITIZENS' RIGHTS TO SPEAK Jean Hughes, 2800 pierce Street, spoke regarding her drainage problems over the past years due to build-up of pierce Street Victor Martin, 3660 Lee Street, addressed trash problems at 38th and Klpllng and suggested solutions S Capillupo, 4875 Harlan, referred to his letter to Council on drainage problems at 48th and Harlan Kay Ore, 10565 W 46th Avenue, read an article from paper re Annexation by Arvada of Garrison Lake project and addressed the decision made administratively instead of legislative PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 1 Public comments, suggestions, and requests regarding the 1985 City Budget Dougal Graham, 3330 Chase, speaking for himself and Area 4 Planning Committee, asked Council to give a lot of thought to the expenditures of the taxpayers' money CITY COUNCIL M TES August 13, 1984 e -2- Louise Turner, 11256 W 38th Avenue, felt the deficit in the budget is due to excessive programs such as curb, gutter, street, and sidewalks She doesn't want a bond issue or sales tax hike; WRURA should be done away with Will Burt, l2290 W 35th Ave , presented a letter from Wheat Ridge Today and Tomorrow, concerning Capital Improvement Projects Item 2 Application for Transfer of Ownership for Cugino's Italian Restaurant, Inc , 5807 West 38th Avenue Applicants Ronald E Evers, 4615 Newland Street, George E Evers, 50ll Fox Hill Drive, Longmont, were present and sworn In by the Mayor and gave background on Cuginos Motion by Mr Hobbs to approve the Transfer of Ownership from Ralph A Acierno to Ronald E and George E Evers, a Corporation, for Cugino's Italian Restaurant, Inc , 5807 W 38th Avenue, Wheat Ridge, a Class P - Beer and Wine Liquor License; seconded by Mr FIasco; carried 8-0 Item 3 Council Bill 135 - An Ordinance providing for the approval rezoning from Residential-Two (R-2) to Restricted Commercial-One (RC-l), with conditions, on land located at Wadsworth Blvd, City of Wheat Ridge, County of Jefferson, State of Colorado (Case No WZ-84-11) (to be continued to of 4701 (Leo P Watson and Richard V McKinley) August 27, 1984 at applicant's request) Motion by Mrs Snow to continue this appllcants' request; seconded by Mr stated that a Legal Protest had been Item 4 item until August 27, 1984 at Wilde; carried 8-0 (City Clerk filed in this case) Council Bill 136 - An Ordinance providing for Health and Life Insurance Policies to be offered by the City of Wheat Ridge as part of their benefit package to employees to be made available to all individuals who have served, or who are presently serving, the City of Wheat Ridge as an Elected Official, or who completed the unexpired term of an Elected Official, from the date of the City's incorporation through the present, providing said former or current Elected Officials pay all premiums for said policies Council Bill 136 was introduced on second reading by ~1r Hobbs; title read by the Clerk t-lr West stated he would vote no because he feels Council will be criticized for favoritism Motion by Mr ~lerkl to Table this Ordinance until the August 27, 1984 meeting for more answers from staff; seconded by ~lr Wilde; Failed 4-4 with Councilmembers Davis, Plasco, Hobbs, and West voting No Motion by Mr Hobbs for the adoption of Council Bill 136 (Ordinance 578) on second reading with the following amendments Second paragraph read "Whereas, the City wishes to make available to said former and present Elected Officials "; and Section l, line 6, read "individuals who have served or are serving the City of Wheat Ridge "; seconded by Mr Davis; carried 6-2 with Mr West and Mr Wilde voting No Item 5 CITY COUNCIL M rES Augus t 13, 1984 ,e -3- Council Bill 138 - An Ordinance providing for the approval of rezoning from Residential-Three (R-3) to Residential-One C (R-IC), on properties located at the following addresses 3850, 3860, 3900, 3950, 3845, 3855 Kendall Street; 3900, 3920, 3930, 3940, 3950, 3945, 3885, 3895, 3915, 3935, 3955 Lamar Street 3860, 3890, 3930, 3960, 3970, 3855, 3925 Marshall Street; 3850, 3870, 3890 Newland Street; and 3990 Jay Street, City of Wheat Ridge, County of Jefferson, State of Colorado (Case No WZ-84-8) Council Bill 138 was introduced on second reading by Mr Wilde; title read by the Clerk Mr Stromberg presented the case and showed slides of the area Applicant Mrs Sweeney, 3895 Lamar, was sworn in by the Mayor and addressed the reasons for wanting the rezoning Also sworn In by the Mayor was John McDermott, 3925 Marshall Street, who reiterated Mrs Sweeney's remarks Motion by Mr Wilde that Council Bill 138 (Ordinance 579) Case No WZ-84-8, a request for rezoning of 28 single family homes to be rezoned from Residential-Three (R-3) to Residential-One-C (R-IC) located at the addresses as listed in the ordinance, be approved for the following reasons A The rezoning brings the subject properties into conformance with what has been developed as single family B The rezoning brings the subject properties into conformance with the Comprehensive Plan; seconded by Mr West; carried 8-0 Item 6 ORDINANCES ON PIRST READING Council Bill 139 - An Ordinance amending Chapter 18 of the Code of Laws of the City of Wheat Ridge by adding thereto Section 18-46(b) authorizing the Chief of Police to sell confiscated or unclaimed firearms to federally licensed firearms dealers for credit which may be used on behalf of the Wheat Ridge Police Department for the purchase of ammunition, targets, and other equipment necessary for use in the Wheat Ridge Police Department Firearms Training Program Council Bill 139 was introduced on first reading by Mrs Keller; title read by the Clerk Motion by Mrs Keller that Council Bill 139 be approved on first reading, ordered published, public hearing set for Monday, August 27, 1984 at 7 30 P m in City Council Chambers, Municipal Building, and if approved on second reading, take effect 15 days after final publication; Failed 4-4 with Councilmembers Wilde, Hobbs, ~eller, and Davis, voting Yes; Plasco, West, Snow, and Merkl voting No Item 7 Council Bill 140 - An Ordinance amending Chapter 15, Parks and Recreation of the Code of Laws of the City of Wheat Ridge by adding thereto Section 15-5(x), Rules for Use of the Richards-Hart Estate, and providing a penalty for violation thereof Motion by Mrs Snow that Council Bill 140 be postponed until August 27, 1984 for corrections seconded by Mr West; carried 8-0 CITY COUNCIL M rES August 13, 1984 ge -4- Item 8 Council Bill 141 - An Ordinance providing for the approval of rezoning from Agriculture-One (A-I), Commercial-One (C-l), and Commercial-Two (C-2) to Planned Residential Development (PRD) and approval of an Outline Development Plan on land located at 11680 W 44th Avenue, City of Wheat Ridge, County of Jefferson, State of Colorado (Case No WZ-84-1) (Warren Johnson) Council Bill l4l was introduced on first reading by Mr Merkl; title read by the Clerk Motion by Mr Merkl that Council Bill 141 be approved on first reading, ordered published, public hearing set for ~londay, September 10, 1984 at 7 30 P m in City Council Chambers, Municipal Bldg , and if approved on second reading, take effect 15 days after final publication; seconded by Mr Davis; carried 8-0 Item 9 Council Bill 142 - An Ordinance providing for the approval of rezoning from Agricultural-One (A-I) to Residential-Three (R-3) on land located at approximately 4200 Moore Street, City of Vfueat Ridge, County of Jefferson, State of Colorado (Case No WZ-84-13) (Phil Haas) Council Bill 142 was introduced on first reading by Mr Davis; title reading by the Clerk Motion by Mr Davis that Council Bill 142 be approved on first reading, ordered published, public hearing set for ~londay, September 10, 1984 at 7 30 P m in City Council Chambers, Municipal Bldg , and if approved on second reading, take effect 15 days after final publication; seconded by Mr Hobbs; carried 8-0 Item 10 Council Bill 143 - An Ordinance vacating a portion of Miller Street, located South of West 44th Avenue within the City of Wheat Ridge, Colorado (Case No WV-84-2) Council Bill 143 was introduced on first reading by Mrs Keller; title read by the Clerk Motion by Mrs Keller that Council Bill 143 be approved on first reading, ordered published, public hearing set for Monday, September 10, 1984 at 7 30 p m in City Council Chambers, t-lunicipal Bldg , and if approved on second reading, take effect 15 days after final publication; seconded by Mr Merkl; carried 8-0 Item 11 Council Bill 144 - An Ordinance providing for the approval of rezoning from Restricted-Commercial (R-C) to Commercial-One (C-l) on land located at 3805 Wadsworth Blvd, City of Wheat Ridge, County of Jefferson, State of Colorado (Case No WZ-84-16) (Kunz Construction for Ken Westand) Council Bill 144 was introduced on first reading by Mrs Snow; title read by the Clerk Motion by t-lrs Snow that Council Bill 144 be approved on first readlng, ordered published, public hearing set for Monday, September 10, 1984 at 7 30 p m in City Council Chambers, Municipal Bldg , and if approved on second reading, take effect 15 days after final publication; seconded by Mr West; carried 8-0 CITY COUNCIL G1H"lTES August 13, 1984 e -5- Item l2 CouncirBill 145 - An Ordinance authorizing the issuance and sale of $4,600,000 City of Wheat Ridge, Colorado, Industrial Development Revenue Bonds, Series 1984 (La Quinta Motor Inns, Inc Project) to finance a project; ratifying certain action heretofore taken; authorizing the execution and delivery by the City of a Loan Agreement, Trust Indenture, Guarantee Agreement, such Bonds and Closing Documents in connection therewith; making determinations as to the sufficiency of revenues and as to other matters related to such project and repealing action heretofore taken in conflict therewith Council Bill 145 was introduced on first reading by Mr West title read by the Clerk Motion by Mr West that Council Bill 145 be approved on first reading, ordered published, public hearing set for Monday, August 27, 1984 at 7 30 P m in City Council Chambers, Municipal Bldg , and if approved on second reading, take effect 15 days after final publication; and with Mrs Snow's correction that Howard Jaquay was Acting City Administrator, Director of Pinance was not here, and Acting City Attorney was Herbert C Phillips seconded by Mr Wilde; carried 8-0 DECISIONS, RESOLUTIONS, AND MOTIONS Item 13 Resolution 904 - approving an Intergovernmental Agreement between the State of Colorado for the use and benefit of the Department of Local Affairs and the City of Wheat Ridge, relating to the Administration of a Community Development Block Grant to provide Improvements to the Water Delivery System within the Southeast Wheat Ridge Water Association, and authorizing the Mayor to execute said agreement Resolution 904 was introduced by Mr Merkl; title read by the Clerk Motion by Mr Merkl for the adoption of Resolution 904 and that the Mayor be authorized to sign the Intergovernmental Agreement with the State of Colorado for the Community Development Block Grant related to water line improvements in the southeast section of the City seconded by Mr Wilde; carried 8-0 ELECTED OPPICIALS' MATTERS City Clerk, Wanda Sang, stated that there are two liquor code violations and asked Council when they would like to hear them Motion by Mr Merkl to start the hearings at 6 00 P m on August 27, 1984; seconded by Mr Hobbs; carried 7-1 with Mrs Snow voting No Mr Davis requested a Study Session on the third Monday in September regarding Wheat Ridge Sanitation District, their future, and expansion of their services; seconded by Mr Hobbs; carried 8-0 Mr Hobbs addressed Mr Cosolo's driveway on 44th Avenue He moved that drive entrance for Mr Cosolo on 44th Avenue be installed; seconded by Mr Davis; Pailed 3-5 with Councilmembers Davis, Plasco, and Hobbs voting yes Mr Hobbs further addressed the property at 41st and Dudley, which needs back fill behind curb and has requested this for 2 years; asked about City vehicles without decals; Chief Jaquay replied the vehicles are in transition from Police Department to staff members CITY COUNCIL MINUTES August l3, 1984 Page -6- Mrs Snow addressed suggestions regarding Crown Hill She asked about Crown Hill Committee which Mr West is a member of She moved to send a letter to the County that the Committee be reinstated but before that on September 17 Study Session a brief discussion on suggestions be held; seconded by Mrs Keller; carried 8-0 She further moved that on the September 17 Study Session a discussion of policy on what width to pave a street when we have a 40ft ROW instead of 50 ft ROW be held; seconded by ~lrs Keller; carried 6-2 with Mr Davis and Mr Merkl voting No Mr West moved to have a report on hours of Senior Center on weekends and cost and number of people attending and are classes scheduled; seconded by Mrs Snow; carried 8-0 t-lr Merkl stated the hold-up on 26th Avenue lS Lakewood They claim Wheat Ridge still has the map and asks W R to please give map back to Lakewood; moved to hold Budget Revenues on September 4, 5, and 6; seconded by Mr Hobbs; carried 6-2 with Mrs Keller and Mrs Snow voting No; further moved to direct staff to put "no parking here to corner" signs on 35th & Penton, 35th & pierce at locations previously approved 6 months ago and signs to be put in within the next 10 days; seconded by Mr. Hobbs; carried 8-0; further moved to allow Mrs Snow as representative of the Community Development Committee to attend the Indianapolis meeting of the National League of Cities; seconded by Mr Hobbs;
