CITY COUNCIL MINUTES
CITY OF WHEAT RIDGE, COLORADO
APRIL 8, 1985
The City Council meeting was called to order by the Mayor at 8 00 P m
Councilmembers present Kent Davis, Tony FIasco, Larry Merkl, Clyde E
Hobbs, Moe Keller, Nancy Snow, Randy West, and Dan Wilde Also present
City Clerk, Wanda Sang; Acting Administrator, Chief Howard Jacquay; City
Attorney, John Hayes; Director of Community Development, Charlie
Stromberg; Director of Parks, Richard Bredt; staff; and interested
citizens
Mayor Stites requested that Item 14A be taken after Item 4
APPROVAL OF MINUTES of March 18, 1985
Motion by Mr Hobbs for approval; seconded by Hr Davis; Mrs Snow
inquired why her reasons for voting yes on Case No SUP-85-1 were
not recorded in the minutes, Clerk related that reasons for voting
yes were never recorded in minutes, only reasons for voting no, but
if Council wanted to have a policy for reasons for voting yes to be
recorded Clerk would be happy to do so Motion by Mr Hobbs that
Mrs Snows reasons not be included in the minutes; seconded by Mr
West; failed 4-4 with Mr West, Mr Hobbs, Mr Davis, and Mr Wilde
voting yes Motion by Mr Merkl to have Mrs Snows reasons
included; seconded by Mr West; carried 6-1 with Mr Hobbs voting
No and Mrs Keller abstaining Mrs Keller stated that she would
be abstaining because she had not received minutes until that day and
did not have a chance to read them
CITIZENS'RIGHT TO SPEAK
Janice Thompson, 12290 W 42nd Ave , representing Parks and
Recreation Commission, regarding The Qualtari Property, stated that
the Parks and Recreation Department supported the purchase of this
land
Fred Moran, 4905 Harlan, stated that he objected to the drainage
plans on 49th and Harlan that is a Denver project He also stated
that it will have an adverse effect on the neighborhood and
requested that the City look in to it and try to relay to Denver
that it could cause flooding The Mayor instructed Chief Jacquay to
investigate

Item 1
Application for a Special Events Permit for Saints Peter
and Paul Church, 3900 pierce Street, to dispense 3 2% beer
and wine on June 29, and June 30, 1985
patricia Weiser, 3510 Harlan, was present representing the
applicant Motion by Mr. Merkl for approval; seconded by Mr
FIasco; carried 8-0
Item 2
Council Bill 170 - An Ordinance amending various sections of
Appendix A, Zoning Ordinance, of the Wheat Ridge Code of Laws,
City of Wheat Ridge, County of Jefferson, State of Colorado,
relating to Multifamily Residential Development Requirements
and Landscaping Requirements
Motion by Mrs Snow to postpone for two weeks until we are able to
get Planning Commission minutes; seconded by Mrs Keller; carried
5-3 with Mr Merkl, Mr Hobbs, and Mr FIasco voting No Motion by
Mr Merkl to republish the Ordinance and hold a Public Hearing on
May 13, 1985; seconded by Mr Davis; carried 8-0
Item 3
Application by Garrison Group for Site Plan approval in the
Kipling Activity Center for property located at 9595 West 49th
Avenue
(Case No WSP-85-1)
Mr Gidley presented Case No WSP-85-1 with overview and slides
Representing Garrison Group and sworn in by the Mayor was
Applicant, Michael S Carson, 262 Victor, Aurora, concurred with
staff Motion by Mr Merkl for approval; seconded by Mr Wilde;
carried 8-0
Item 4
Application by Garrison Group for Site Plan approval in the
Kipling Activity Center for property located at 9545 West 49th
Avenue
(Case No WSP-85-3)
Mr Gidley presented Case No. WSP-85-3 with overview and slides
Motion by Mr Wilde for approval; seconded by Mr West; carried
8-0
Item 14 A) Resolution 940 - approving the revision of the Kipling
Activity Center Urban Renewal Plan and area
Charlie Stromberg and Rick Kirkwood presented the case with
overview and slides, and commented on Wheat Ridge Urban Renewal
Authority and expansion of Kipling Activity Center Representing
Urban Renewal Authority and sworn in by the Mayor was; Donald
Lancaster, 4076 Everett, gave comment on Urban Renewal Authority
recommendations Dr. Ramona Reed, I0185 W 49th Ave , voiced her
concerns to Council

Charles Sanders, 288l Olympia Lane, Evergreen, Pointed out his
concerns for his property Motion by Mr Merkl that at this point
and until Council has received a letter of intent from Pace Club,
letting them know that they are interested and do want this
property, this Urban Renewal Plan be postponed to allow both
staff, City Council" Planning Commission, and Urban Renewal
Authority more time to study it; seconded by Mr Flasco; Discussion
followed Mrs Keller stated that she would be voting no because
she feels even without Pace this should be extended for Urban
Renewal Authority Mr Davis called for the question; seconded by
Mr FIasco; carried 8-0 Vote on question failed 4-4 with Mr
Wilde, Mr FIasco, Mr Davis, and Mr Merkl voting yes Motion by
Mrs. Keller for the adoption of Resolution 940; seconded by Mr
Merkl; Motion by Mr Merkl to amend to put this into the Urban
Renewal Authority for 1 year to be reviewed by City Council Mrs
Snow stated that she would like the word "shall" in place of "can"
in the Resolution Mr FIasco stated that he would be voting no
because the only reason Council is doing this is because it leaves
the properties open to condemnation, there are to many
inconsistancies Mr Hobbs called for question; seconded by Mr
FIasco; carried 7-1 with Mrs Keller voting No Vote on original motion
carried 5-3 with Mr Hobbs, Mr FIasco, and Mr Davis voting No

Council Bill 183 - An Ordinance amending Section 4-4 1 of the
Code of Laws of the City of Wheat Ridge, relating to animal
caused disturbances
Council Bill 183 was introduced on first reading by Mr. Merkl;
title read by the Clerk; Motion by Mr Merkl that Council Bill 183
be approved on first reading, ordered published, public hearing be
set for Monday, May 13, 1985 at 7 30 p m in City Council Chambers,
Municipal Bldg , and if approved on second reading, take effect 15
days after final publication; seconded by Mr Davis; discussion
followed Dr Hilsenroth, of Animal Control Commission was present
and answered questions Carried 6-2 with Mrs Snow and Mr FIasco
voting No

Council Bill 184 - An Ordinance amending Section 2-17(a) of the
Code of Laws of the City of Wheat Ridge requiring members of
Boards and Commissions to resign their position as a member of
a Board or Commission upon becoming a candidate for elective
office within the City of Wheat Ridge
Council Bill 184 was introduced on first reading by Mr Hobbs;
title read by the Clerk; Motion by Mr Hobbs that Council Bill 184
be approved on first reading, ordered published, public hearing be
set for Monday, May 20, 1985 at 7 30 P m in City Council Chambers,
Municipal Bldg , and if approved on second reading, take effect 15
days after final publication; seconded by Mr Davis; carried 6-2
with Mrs Snow and Mr West voting No

Council Bill l85 - An Ordinance amending Appendix A, Zoning
Ordinance, of the Code of Laws of the City of Wheat Ridge by
amending Section 25 thereof extending the period of
non-conforming uses of structures until July 1, 2000
Council Bill 185 was introduced on first reading by Mr Merkl;
title read by the Clerk; Motion by Mr Merkl that Council Bill 185
be approved on first reading, ordered published, public hearing be
set for Monday, May 20, 1985 at 7 30 P m in City Council Chambers,
Municipal Bldg , and if approved on second reading, take effect 15
days after final publication; seconded by Mr. Hobbs; carried 7-1
with Mrs Snow voting No

Council Bill 186 - An Ordinance providing for the approval of
rezoning from Agricultural-One, Commercial-One, and Planned
Industrial Development, to Commercial-Two with the condition
that uses permitted shall be only all Commercial-One uses and a
combined retail/wholesale use on property located east of
Kipling Street, north of West 49th Avenue, west of Miller
Street and south of the Public Service Company transmission
line easement
(Case No WZ-85-9) (City of Wheat Ridge)
Council Bill 186 was introduced by Mr Merkl on first reading;
title read correctly by the Clerk; Motion by Mr Merkl that
corrected Council Bill 186 be published in the Sentinel with public
hearing set for Monday, May 13, 1985 7 30 P m in the City Council
Chambers, Municipal Bldg , and if Pace or comparable retail facility
has not given a letter of intent by May 13, 1985 this Ordinance
will be withdrawn; Mr Davis stated that he will be voting no
because he does not know what comparable is Carried 5-3 with Mr
Hobbs, Mr Davis, and Mr FIasco voting No
Item 9
DECISIONS, RESOLUTIONS, AND MOTIONS
Resolution 941 - authorizing the Mayor to sign the
Intergovernmental Agreement entitled Request for Payment and
certification of use of funds for improvements to the entrance
road at Wheat Ridge Park; and
Motion to award the bid for the reconstruction of the park
entrance located at 44th Avenue & Field Street to Flatiron
Paving Company for their alternate bid in the amount of
$49,782 92, including the 10% Contingency, to be charged to
Account No 32-603-858
Resolution 941 was introduced by Mrs Keller; title read by the
Clerk Motion by Mrs Keller for the adoption of Resolution 941;
seconded by Mr Merkl; Mr Davis amends that no construction begin
until we are sure we have open space funds; seconded by Mr FIasco;
failed 4-4 with Mr Hobbs, Mr. FIasco, Mr Davis, and Mr Wilde
voting yes Vote on original motion carried 8-0.

Item 10 A) Motion that the City of Wheat Ridge accept the proposal by
NCR for the purchase of 2 NCR Worksaver 300 stations with 1
letter quality printer and 1 NCR Firstep wordprocessor in the
amount of $15,896, and the purchase of 1 Okidata 93 dot matrix
printer in the amount of $598 00 Total purchase price _
$16,424 to be paid from accounts 19-103-809 - $14,224 _
(Treasury) and accounts 19-109-802 - $900 and account
19-109-809 - $1,300 (Court)
Motion by Mr Merkl for approval; seconded by Mrs Keller;
Discussion followed, item was budgeted carried 7-1 with Mrs Snow
voting No
Item 10
B) Motion that $12,589 be approved for the purchase of two
(2) NCR Computer Stations for the Community Development
Department
Motion by Mr West for approval; seconded by Mr Merkl; Mr Davis
stated that he would be voting no because this item was not
budgeted Hrs Snow stated that she would be voting No because the
item was not budgeted and wants Planning Department to cutback on
paper and time it takes to put it out Mr West stated that he would be
voting No because the item was not in the budget; failed 2-6 with
Mrs Keller and Mr Merkl voting yes
Item 11
Motion that the City of Wheat Ridge accept the proposal of
Colorado On-Line Systems, Inc for a sales/Use Tax Software
Package
Motion by Mrs Keller that the City of Wheat Ridge accept the
proposal of Colorado On-Line Systems, Inc , at a FIXED COST of
$17,000 without the City holding proprietary rights This amount
to be paid from General Fund Unallocated - 01-607-795; seconded by
Mr Merkl; Mr Davis stated that he would be voting No because this
was not a budgeted item Carried 5-3 with Mr FIasco, Mr Hobbs,
and Mr Davis voting No

Motion by Mrs Snow to hold an Executive Session on 5 7 82 of
Charter; seconded by Mrs Keller; carried 8-0
Meeting adjourned at 12 00 midnight
