Supp. No. 20 1623 . . . . . URBAN RENEWAL ~ 25-25 ARTICLE L IN GENERAL Sees. 25.1-25.20. Reserved. ARTICLE n. URBAN RENEWAL AUTHORITY Sec. 25-21. Findings of fact. Based upon all of the evidence presented to it at a public hearing, notice of which was duly published, and after considering such factors as the physical condition and age of the buildings in particular areas of the city, the aggravated traffic problems created by present street layouts in portions of the city, and the impairment of sound commercial growth patterns within portions of the city and their adverse effect upon the future development of the city, the city council hereby finds as follows: (1) One (1) or more blighted areas exist within the city; and (2) The acquisition, clearance, rehabilitation, conservation, development, redevelop- ment or a combination thereof, of such areas is necessary in preserving and en- suring the public health, safety and wel- fare of the residents of the city. (Code 1977, ~ 23-1) Sec. 25-22. Declaration of need for author. ity. The city council hereby declares that is in the public interest for an urban renewal authority, created pursuant to the Urban Renewal Law [C.RS. ~ 31-25-101 et seq.], to function within the city and to exercise the powers provided therein, except as the same may be limited, constrained or proscribed by any approved and adopted urban renewal plan. (Code 1977, ~ 23-2; Ord. No. 1992-897, ~ 1,6-8-92) Sec. 25-23. Economic development and revi. talization commission estab. lished-Rights and duties gener- ally. The Wheat Ridge Economic Development and Revitalization Commission is hereby organized Supp. No. 20 and established. Such commission is hereby vested with all of the rights contained, and is authorized to carry out all of the duties and functions as provided in the Urban Renewal Law [C.RS. ~ 31-25-101 et seq.], as it now exists or as amended in the future, unless such powers and authorities are limited or constrained by or within any ap- proved urban renewal plan; provided, however, that the use of eminent domain shall not be undertaken without the approval of the majority of the city council having first been obtained. (Code 1977, ~ 23-3; Ord. No. 1992-897, ~ 2, 6-8-92) Sec. 25.24. Same-Appointment of members; number. The commission shall consist of nine (9) com- missioners, two (2) of such commissioners being from each of the existing, or hereafter altered, city council districts, and one (1) commissioner to serve at large. Each appointment to the commis- sion shall be made by the mayor subject to ap- proval by majority vote of the entire city council. The term of office of each commissioner shall be five (5) years. Any commission member who shall change his personal residence to an address' out- side the city or outside the district he represents shall cease to be a member of the commission and his seat shall automatically be deemed vacant as of the date on which he ceased to be a resident of the city or of the district. Members whose term has expired shall continue to hold office until his successor has been appointed and has qualified. Terms of office shall be staggered so that the term of at least one (1) commissioner shall expire each year. (Code 1977, ~ 23-4; Ord. No. 1992-897, ~ 3, 6-8-92) Sec. 25-25. Additional duties. The Wheat Ridge Economic Development and Revitalization Commission shall also serve in an advisory capacity to the city council regarding economic development throughout the City of Wheat Ridge. Specific duties shall include, but not be limited to: (a) Assist the city manager in the formation of a business development plan. (b) Provide advice and assistance to the city council and administrative staff in busi- 1625 ~ 25-25 WHEAT RIDGE CITY CODE ness development programs and strate- gies designed to retain existing busi- nesses, encourage expansion of existing businesses, and to aid in the development of new business. (c) Assist the administrative staff with pro- motional efforts for the city's business development program. (d) Review specific business development pro- posals and advise the administrative staff on business incentives and other related city programs. (Ord.
