If changes have been or if suspension or abandonment exceeds one (1) year, full fees shall
be paid for a new permit.

5. Contractor shall notify the Building Inspector twenty-four (24) hours in advance for all inspections and shall receive
written approval on inspection card before proceeding with successive phases of the job.

an approval of, any violation of the provisions of the building codes or any other ordinance, law, rule or regulation.All plan review is subject to eld inspections.

4. Indemnification.
The Permittee for itself and its heirs, successors and assigns, hereby releases and
discharges the City, its employees, agents and assigns from any liability and from any
and all claims, demands, damages, actions, causes of action, or suits of any kind or
nature whatsoever related to or arising from Permittee's occupation of the public right-of-
way permitted hereunder. The Permittee agrees that the City may elect to provide its
own defense or to require Permittee to provide such services. The Permittee shall be
liabie for all costs and fees related to the defense, regardless of which party provides the
services.
5. Insurance.
(a) No permit shall be issued or remain in effect unless the Permittee obtains
and maintains in fqrce and on file with the Public Works Department, sufficient
evidence of a general liability policy covering injury to or destruction of property
and bodily injury, including death, to at least the liability limits established by
Section 24-10-114, Colorado Revised Statutes, (currently $150,000 per person
and $600,000 per occurrence) and as hereafter may be amended.
(b) Required coverage may be evidenced by endorsement, with the city
named as an additional insured, and providing for thirty (30) days' notice to the
Director of Public Works or his designee in the event of any material change in or
cancellation of the coverage. .

As I stated the in our conversation on November 13, 2008, the Public Works Department has informed me there
are 8 bus bench locations with 16 benches throughout the City that share the same location as bus shelters.
According to Public Warks, CDOT does not allow bus shelters and bus benches to be located at the same
location, therefore they must be removed. The following is a list of the approximate addresses that the Public
Works Deparhnent has provided me with of the bus benches will need to be removed. Each location has two
benches.
11691 W. 44ti' Ave - North side
10399 W. 44°i Ave - North side
3400 Youngfield St. - East side
3865 Kipling St. - West side
10101 W. 38`h Ave - South side
4643 Wadsworth Blvd. - West side
3502 Wadsworth Blvd. - East side
3195 Wadsworth Blvd. - West side
In addition to the benches being removed in these locations, a request from the Mayor has been received to
remove two additional benches. One bench is on the north side of the street along W. 32id Ave at Sheridan Blvd.
The second location is along W. 32"a Ave. at Fenton on the south side. It seems that when these non-advertising
benches were installed, the benches that were previously there were inoved back and placed behind your newer
benches. The mayor requested that the older benches made of wood and cement be removed and the newer,
cement and metal benches remain.
The Public Works Deparhnent requests that these benches be removed by no later than November 30, 2008. A
bench inspection will take place on December 1, 2008 to ensure the benches have been removed. After the
benches have been removed a prorated check for of the original fees far the 16 advertising benches will be
mailed to you since the benches have been in place for 9 months.

Sorry for the delayed response but I finally have had the chance to get out to do the final
inspections. Every thing looks good and 1 have signed off your permit. I made a note of being
refunded $200.00 on the permit for the 2 benches W. 4e and Kipiing and the 2 benches at W.
44`h and Tabor ($50.00 each) a check should be cut and mailed to you during one of our next
check cycles.

I hope you have been well. I just left you a voicemail regarding the letter you mailed me. I just
wanted to let you know that everything on the letter has been addressed. That's works for me if
you credit us for the amount for 44th & Kipling, SW corner. We applied for two new benches at
44th & Tabor on the SE corner this location now has a shelter at it as weil, so we won't be
installing any benches at this location. If you could credit this $100 as well that would be great.
Those iwo locations will bring the amount owed down to $200 less. Let me know once you get
everything figured out on your end and I'll send you over a check for the new amount and you can
give me back the old one if that is easiest for you.

placement of benches at the new locations which you applied for.

This letter is to serve as a reminder that the re-application deadline to retain ownership of a current permit for any
and a11 bus benches in the City is March 1, 2008. One miscellaneous building permit can be submitted for
multiple bus benches. Please note the following:
• An updated list of the locations of all benches, along with some type of site plan showing the location
of each bench needs to be submitted with the application.
• An applicadon for right-of-way permit must be obtained from the Public Warks Department in order
to be able to do work in city Right-of-Way.
• The distance from the edge of pavement to each bench should be indicated on the site plans as a
requirement of the Public Works application for right-of-way permit. All benches for bus stops shall
be installed parallel with the street, and set back approximately three (3) feet, but not more then eight
(8) feet, from the paved roadway or curb.
• No more then two bus benches shall be located at one bus stop.
• Bus benches with advertising are assessed at $50 per bench on the building permit application.
• Please note, per Sec. 21-124(e) of the City of Wheat Ridge Code of Laws, for every 5 benches
allowed with advertising, 1 bench must be provided without advertising located in one of the
following zone districts: R-1, R-IA, R-1B, R-1C, R-2, R-2A, A-1, A-2, and PF. If you need
assistance finding a location in one of these zone districts, please contact me at the number below.
• Per Sea 21-127 of the City of Wheat Ridge Code of Laws a valid sign contractor's license with the
City is required with the application, which also requires submittal of a copy of the applicant's
liability insurance (per Sec. 21-147).
After the application has been submitted and found to be complete, subsequent inspections will take place to
ensure the correct placement and condition of the bus benches specified in the permit and pursuant to the City's
regulations. After a11 necessary conections and repairs have been made, the permit may be issued.
