COMMISSIONERS DEED
THIS INDENTURE made this 6th day of January, 1987,
bet~e~n the County of Jefferson, State of Colorado, a body
polltlc and corporate acting by and through its duly
constituted and appointed Commissioner, Marjorie E. Clement, I _ ~
to convey and to execute deed, first party and City of Wheat
Ridge, State of Colorado, a municipal corporation, second
party,
WITNESSETH
THAT WHEREAS, the Board of County Commissioners of the
County of Jefferson, State of Colorado, did at a regular
meeting of , said Board held at the Courthouse in said County
on the I~~ day of of January, 1987, duly adopt and pass
Resolution No. CC87-19 authorizing the conveyance of the
hereinafter described real property to second party, and did
by said resolution appoint and constitute the undersigned as
Commissioner to convey and execute deed for said real estate
and water rights to second party for and on behalf of the
said County of Jefferson, State of Colorado, a body politic
and corporate, and did further authorize the undersigned to
execute this deed and to affix the seal of said County he~eto.
NOW, THEREFORE, FOR AND IN CONSIDERATION of the sum of
Ten (SID. 00) Dollars and other good and valuable
consideration, in hand paid by second party to said County of
Jefferson, State of Colorado, a body politic and corporate,
receipt of which is hereby confessed and acknowledged, the
undersigned, acting as Commissioner aforesaid, does by these
presents remise, release,sell, convey and quit claim unto
second party, its successors and assigns for so long as the
following described property and water rights are used
exclusively for public open space, park and recreational
purposes and no longer, all the right, title, interest, claim
and demand which said Jefferson County, State of Colorado, a
body politic and corporate, has in and to the following
described real property and water rights situate, lying and
being in the County of Jefferson, State of Colorado:
PARCEL D
A portion of Block 12, Lee's Subdivision (Plat Book 2, Page
23A), situated in the Southeast One-Quarter (1/4) of Section
20, Township 3 South, Range 6 9 \~est of the Sixth Principal
Meridian, County of Jefferson, State of Colorado, being more
particularly described as follows:
Commen~ing ~t the. East One-Quarter (1/4) corner of said Section
20, sa~d po~nt be~ng on the East boundary line of said Block
12; thence along said East boundary line of Block 12 South
00"09'24" E~st: 345.92 feet to the True Point of Beginning,
thence cont~nu~ng along the East boundary line of said Block ~
12, South 00009'24" East, 343.05 feet; thence South 89"31'35" "-
West, 177.73 feet: thence North 00008'11" West. 342.69 feet:

Meridian. County of Jefferson. State of Colorado. being more
particularly described as follows:
Commencing at the East One-Quarter (1/4) corner of said Sect~on
20, said point being on the East boundary line of said Block
12; thence along said East boundary line of Block 12, South
00"09'24" East, 688.97 feet; thence South 89"31'35" West.
177.73 feet to the True Point of Beginning: thence continuing
on the previous course, South 89"31'35" West, 177.73 feet;
thence North 00006'57" West, 342.33 feet, thence North
89"24'36" East. 177.61 feet: thence South 00"08'11" East,
342.69 feet to the True Point of Beginning.
Together will all water and water rights, ditches and ditch
rights, reservoirs and reservoir rights. wells and well
rights, both tributary and nontributary, on, under and
appurtenant to or used on the lands herein described,
including, but not limited to, three (3) inches of water from
the Lee and Baugh Ditch.
TO HAVE AND TO HOLD the same, together with all and
singular appurtenances and privileges thereunto belonging or
in any way thereunto appertaining, and all the estate, right,
title, interest and claim whatsoever of said Jefferson
County, State of Colorado, either in law or equity, to the
only proper use, benefit and behoof of the said second party,
its successors and assigns, but if the second party, its
successors and assigns shall use said property for any
purpose other than public open space, park and recreational
purposes, said property shall revert to the first party and
this deed shall be null and void.
