AN ORDINANCE PROVIDING FOR THE VACATION OF ZINNIA
STREET BETWEEN WEST 32ND AVENUE AND WEST 33RD AVENUE,
AND FOR WEST 33RD AVENUE BETWEEN ZINNIA COURT AND
T.NTERSTATE 70, CITY OF WHEAT RIDGE, COUNTY OF
JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO:
TITLE:
Section 1. Upon applicatio~ of Dwaine R. Richter for vacation
of Zinnia Street between West 32nd Avenue and West 33rd Avenue,
and for West 33rd Avenue between Zinnia Court and Interstate 70.
in Wheat Ridge Case No. WV-78-01, and upon recommendation fo=
approval of vacation of Zinnia Street between We3t 32nd Avenue
and West 33rd Avenue, and for West 33rd Avenue between Zinnia
Court and Interstate 70, from the Wheat Ridge Pl,nning
Commission, and it appearing that the roadway does not
constitute the boundary line of the City of Whea_ Ridge,
that the vacation of said roadway shall not leave any land
adjoining said roadway without an established public road
~onnecting said land with another established pvhlic road,
and based upon findings made pursuant to testimony and
evidence presented at public hearing before the Wheat Ridge
City Council, the roadway known as Zinnia Street between
West 32nd Avenue and West 33rd Avenue, and West 33rd Avenue
between Zinnia co.)~.t and Interstate 70, more specifically
described as follows, be and hereby is vacated:
Beginning at a point 40.02 feet north of the south line
of the NW 1/4 of Section 29, T3S, R69W of the 6th P.M.,
and 700 feet east of the west line of the NW 1/4 of said
Section 29, said Point of Beginning being on the easter.ly
line of Applewood Gardens, a Subdivision, filed in the
offbce of the Jefferson County Clerk and Record~r; thence
N89 43.5'E parallel to the south line of the NW 6/4 of
said Section ~9 a distance of 25 feet; thence NO 48.2'W
parallel to t~e east line of said Applewood Gardens a
distance of 573,56 feet to a point 5 feet south of the
southerly line of West 33rd Avenue, as dedbcated on the
plat of said Applewood Gardens; thence N89 39'E parallel
to the south line of said West 33rd Avenue a distance of
243.89 fest to the ~:tended easterly line of said Subdivision;
thence NO 30'W along the extended east line ~nd the east line
of said SUbdivision, a distance of 75 07 fe~t to the point of
curvature of a 25 foot radius curve on the easterly line of
said SUbdivision; thence southerly and westerly along the
southeasterly line of Lot 11, Block 4, of said Applewood
Garde~s a distance of 39.~4 feet to the point of tangency
of sald curve; thence S89 39'W along the northerly line of
said West 33rd Avenue a distance of 384.05 feet to a point
on the ex~ended west line of Lot 8, Block 1 of said Subdivision;
thence SO 48.2'E along said extended west line a distance of
50 beet to the south line 0 said West 33rd Avenue; thence
N89 39'E along the south Ij.~e of said West 33rd Avenue a
distance of 100.12 feet to the point of curvature on the
northerly line of said Lot 8; thence easterly and southerly

along the northerly and easterly line of said Loto8 a distance
of 23.44 fp.et to the point of tangency; thence SO 48.2'E along
the westerly line of Zinnia Street 3S shown on the filed plat
of said Subdivision, a distance ~f 553.53 feet to the point of
curvature of a 15 foot radius curve on the southeast corner
of Lot 14 of said Block 1; thence southerly and southwesterly
along said curve, a distance of 5.23 feet to a point 40.02 feet
norbh of the south line of the NW 1/4 of said Section 29; thence
N89 43.5'E, a distance of 25.90 feet to the Point of Beginning.
Section 2. This ordinance shall take effect fi fteen days
after final publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of
-L to 2 on this 2.l..s.L day of Auoust , 1978;
ordered published in full in a newspaper of general circulation
in the City of Wheat Ridge and Public Hearing and consideration
on final passage set for September 11 , 1978, at
7:30 o'clock p.m., at Counc11 Chambers, 7500 West 29th
Avenue, Wheat Ridge;-Colorado.
READ, ADOPTED, AND ORDERED PUBLISHED on second and flnal
reading by a vote of 4 to 2 ,this ~ day (If
