HomeMy WebLinkAboutTom Hawn111111 VIII VIII VIII VIII VIII VIII VIII VIII VIII IIII IIII D S01 0° 2013078499 06/28/2013 09:38:00 AM 7 Page(s) JEFFERSON COUNTY, Colorado 0 9 DEVELOPMENT COVENANT AGREEMENT THIS AGREEMENT made this 6th of June, 2013 by and between the Lp CITY OF WHEAT RIDGE, COLORADO, a home rule municipal corporation (the "City "), and Tom Hawn, (the "Applicant "), together referred to as the "Parties ". 1 er� RECITALS: I WHEREAS, The Applicant is the owner of certain real property located in the City of Wheat Ridge, which is more particularly described in Exhibit A and made a part hereof (the "Property "), commonly known as 4880 and 4900 Robb Street. WHEREAS, on March 25, 2013 the City of Wheat Ridge, after holding all required public hearings, as prescribed by the Code of Laws, approved the Final Plat for the Property titled Hawn Subdivision. A copy of the Final Plat is attached hereto as Exhibit B, and is incorporated herein. WHEREAS, the parties hereto understand and agree that the intent of this Agreement is to establish the obligations and expectations for development of the Property, and that the Applicant may not be involved with development of the Property, and therefore should not be responsible for such site improvements as indicated on the approved Final Plat held by the Community Development Department. WHEREAS, the entity who improves the property ( "Developer ") may be a successor or assign of the Applicant, and shall be required to comply with all applicable sections of Chapter 26, Articles III and IV of the Wheat Ridge Code of Laws. The Developer shall also be responsible to furnish all financial guarantees as determined by the Director of Public Works and the Community Development Director jointly. THEREFORE, the approval of the Final Plat by the City of Wheat Ridge, the dedication of certain land and /or easements to the City of and other good and valuable considerations, the parties hereto agree as follows: 1. Intent of Development Covenant Agreement: This Agreement is intended to control the development of the property. The terms of this Development Covenant Agreement shall remain in full force and shall bind the property until such time that the Developer executes a Subdivision Improvement Agreement or Public Improvement Agreement, whichever is applicable, (herein referred to as "Future Agreement ") in preparation of property development. The executed Future Agreement shall replace this Development Covenant Agreement in its entirety and shall bind the Developer to complete all required improvements as referenced in this document as approved Development Covenant Agreement by the City of Wheat Ridge Director of Public Works and the Community Development Director jointly. Once a Future Agreement has been approved by the City and recorded with the Jefferson County Clerk and Recorder, this Development Covenant Agreement shall be released. 2. Sale of Property: This Development Covenant Agreement shall prevent the sale of individual lots, or a collection of individual lots which do not equal the total sum of the property as described in Exhibit A until such time that a Subdivision Improvement Agreement or has been executed. This shall not prevent the Applicant from conveying or selling the entirety of the property as legally described on Exhibit A to a third party. 3. Issuance of Building Permits: The City of Wheat Ridge shall not issue any building permits for individual lot(s) until an approved Future Agreement has been executed. Building permits for individual lots may be issued by the City of Wheat Ridge at such time that a Developer has signed and complies with all terms listed in a Future Agreement. 4. Fees Associated with Development of Property: All building permit fees, review fees and security for construction of public improvements shall be paid by the Developer as executor of the Future Agreement. The Applicant shall not be responsible for the payment of such fees, unless the Applicant executes the Future Agreement as the property Developer. The Applicant shall be responsible for all recording fees associated with this Development Covenant Agreement as specified by the Jefferson County Clerk and Recorder. 5. Improvements to Right -of -Way: PRIOR TO THE SALE OR DEVELOPMENT OF LOT 2 OF HAWN SUBDIVISION, PUBLIC IMPROVEMENTS SHALL BE COMPLETED ACROSS THE ENTIRETY OF THE ROBB STREET FRONTAGE OF THE SUBDIVISION. PLEASE NOTE THE FOLLOWING REQUIREMENTS: A. ENGINEERED DRAWINGS SHALL BE SUBMITTED TO THE DEPARTMENT OF PUBLIC WORKS FOR REVIEW AND APPROVAL PRIOR TO CONSTRUCTION. THE CONSTRUCTION DRAWING S SHALL CONTAIN THE FOLLOWING ITEMS: 1. CROSS - SECTIONS WITH SUFFICIENT INFORMATION TO DETERMINE PROPER ROADWAY CROSS - SLOPE, DRAINAGE, AND MATCH TO THE EXISTING GROUND TO THE EAST. a. A PLAN AND PROFILE OF THE CURB AND GUTTER. b. CITY - STANDARD DETAILS OF THE ASPHALT SECTION AND THE CURB & GUTTER MUST BE INCLUDED. B. THE CURB & GUTTER AND ASPHALT PAVEMENT SHALL BE CONSTRUCTED IN ACCORDANCE WITH CURRENT CITY STANDARDS. Development Covenant Agreement 2 C. THE ALIGNMENT OF THE CURB & GUTTER SHOULD BE AN EXTENSION OF THE EXISTING CURB & GUTTER LYING DUE SOUTH OF THE HAWN SUBDIVISION, AND BE COMPLETED ACROSS THE ENTIRETY OF THE ROBB STREET FRONTAGE. THE NORTHERLY PORTION MAY NEED TO BE ANGLED EASTERLY TO MATCH INTO THE EXISITNG CURB & GUTTER TO ADEQUATELY THE STORMWATER DRAINAGE. D. A SIDEWALK MAY BE CONSTRUCTED ACROSS THE ROBB STREET FRONTAGE BUT IS NOT REQUIRED HEREIN. 6. Improvements to Property: There shall be no site work performed on the property until a signed Future Agreement has been executed and the proper permits have been issued by the City of Wheat Ridge. For these purposes, "site work" is defined as any grading, clearing, excavation or deposition of materials in conjunction with site development consistent with the approved Final Plans. Nothing in this paragraph shall prevent the demolition of any existing structures, or the general maintenance of the property, provided proper permits are issued by the City of Wheat Ridge.
