TITLE. AN ORDINANCE VACATING A CERTAIN PART OF A STREET LOCATED WITKIN 3
TKE CITY OF WHEAT RIDGE': I.E. VACATING A CERTAIN DESCRIBED STREET LYING \".-
IN PART OF THE SOUTHWEST ONE-QUARTER (SI1/ j\) OF SECTION 15, TOWilSHIP :I
SOUTH, RANGE 69 WEST OF THE SIXTH (6TH) PRINCIPAL MERIDIAN.
WHEREAS, by a deed recorded in Book 742 at page 232 of the
Jeffereon County Records, a certain stre8t was dedicated to the public;
and
WHEREAS, the following described street is no lcnger necessary
for use by the public; end
WHEREAS, seid street is within the limits of the City of
Wheat Ridge; and
WHEREAS, no land would, by a vacation of said street be left
without an established public road connecting it with another established
~ublic road; and
WHEREAS, the Wheat Ridge Planning Commission has approved the
v3cation of said street.
BE IT ORD~INED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. The foll~wing described street in the Gity of
Wheat Ridga, Colorado, be vacated, to wit;
The West Fifteen (15) feet of Block Two (2), Juchem Garden
Place, lying and being in the County of Jefferson, and
State of Colorado, as recordsd in Deed Book 742 at Page
232 0f the Jefferson County Records.
And the same is hereby approved and the described street 1s
hereby vacated; provided, however, said vacation shall be subject to
the following conditions and reservations;
There 1s a reserved to the City of Wheat Ridge and to uti11~y
owners the continued use and right to construct, operate, and maintain
sewer, power, t81Gphon~1 Gnd gas lirgs is said vacated street.
Section 2. Emergencv Clause. The provisions of this ordin~nca
are necessary to the immediate preservation at the public health and

safety of the citizens of the City of Wheat Ridge for the following
rea50:l5;
1. No ordinance has been previously passed relating to the 1\/
vacation of this street because the City having just completed incor- r/'
poration August 20, 1969, has not heretofore adopted any ordinances
vacating this street.
2. An ordinance vacating this street is necessary to allow
the orderly developmnet of this area.
Section 3. Effective Date. This ordinance shall take effect
and be in force five (5) days after publication following final passage
providing it shall have been passed by en afFirmetive vote of three-
Fourths (3/4) of the members of the City Council; otherwise said
crdinance shall take efFect thirty (30) days aFter publication following
Final passage.
