TITLE. AN ORDINANCE VACATING A CERTAIN PART OF A STREET LOCATED WITHIN THE
CITY OF ulHEAT RIDGE: 1.E. VACATING A CERTAIN DESCRIBED STREET LYING IN PART
OF THE SOUTHWEST ONE-QUARTER (S~h) OF SECTION 15, TOWNSHIP 3 SOUTH, RANGE 69
wEST OF THE SIXTH (6th) PRINCiPAL MERIDIAN.
~IEREAS, by a plat recorded in Book 2 at Page 1 of the Jefferson
County Records, a certain street was dedicated to the pualic; and
WHEREAS, the fo11ol.,ing described street is no longer necessary for use
by the public; and
WHEREAS, said straet is within the limits of the City of Whezt Ridge;
end
~EREAS, no land would, by a vacation of said streat be left without an
established public road connecting it with another established public road:
and
WHEREAS, the Wheat Ridge Planning Commission has approved the vacation
of eaid streat.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Sacticn 1. The following described street in the City of Wheat Ridge,
Colorado, be vacated to w~t:
The East 30 feet of the South 529.82 feet of the North 559.B2 feet
of the SW ~ SE ~ SW ~, Section 15, Township 3 South, Range 69 West
of the 6th Prl.nc1pal Meridian, County of Jefferson, State of Colorado.
And the same is hereby approved and the described street is hereby vaca-
ted; provided, however, aaid vacation shall be subjec" to the followlng
conditione end reservations;
There is reserved to the City of Wheat Riege and to utility owners the
continued use end right to construct, operate, and maintain sewer, power,
telephone, end gas lines in said vacated street.
Section 2. Emergency Clause. The provisions of this ordinance ere
necesssry to the immediate preservation of the public health and safety of
the citizens of the City of Wheat Ridge for the following reasons:
1. No ordinence has been previously passed reletin~ to the vacation of
this street becaupe the City having just completed incorporation August 20,
1969, has not herstofore adopted any ordinances vacating this street.
2. An ordinance vacating this street is necessary to ellow the orderly
devGlopment of this erea.
Section 3. Effective Date. This ordinance shall takA effect end be in
force thirty (30) days after publication following final passege.
