deceased. late of the City and County o[ Denver and State of Colorado, the First
Party, and the DEPARTMENT OF HIGHWAYS, STATE OF COLORADO, the Second Party,
THl.T WHEREAS the said Herman C. Haffner departed this life on or about the
31st day of March. 1964. leaving an instrument in writing dated the 16th day of

WHEREAS the ~aid instru~nt in ~iting was filed in the County Court in and
for the City and County of Denver and State of Colorado, and there~fter. upon
hearing, duly proven and admitted to Probate as the Last Will and Testament of
~2:id dec'!dpnr-, by an Order of said Court made and entered therein on the 20th
day of April, 1964. and
WHEREAS, pursuant to tne terms of said Last Will and Testament, the said Ivy
Myrtle Haffner was, by an Order of said Court, mad~ dnd cfitel:'.2G therein on the
20th day of April, 1964, appoinced 88 Executrix of the Estate of said decedent,
and then and there be~ame. and now i8, the duly appointed, qualified and acting

WHEREAS, under the provisions of said Last Will and Testament, the Firat
Party was given full power and authority to sell the property of said decedent,
in the words and figures following. to~wlt:

"I hereby direct that all estate and inheritance taxes if any shall
be paid out of the residue of my said estate and I hereby give

WHEREAS the First Party has received a bona fide offer from the Second
Party for the purchase of said real pr~perty. for a vaJuabI~ consideration,
whic:h the First rarty deems meet anj proper, and in the best interestS of
said Estate.
NOW THEREFORE BE IT KNOWN
TIlAT the First Party, by virtue of the power and authority in her vested by
toe Last will and Testa~nt of H. C, Haffner, sometimes known as Herman C,
Haffner and Herman Haffner, deceased. and for and in consideration of the sum
of EIGHT THOoSAND EIGHT HUNDRED DOLLARS ($8,800,00) and other good and valuable
considerations to her in hand paid by the Second Party. receipt whereof is
hereby confessed and acknowledged, has given, granted, bargained sold and conveye~.
and by these pr~sents does hereby give. grant, bargain, sell, convey and ccn1irm
unto the Second Party, its successors and assigns forever, the following real
property situatec in the County of JefferS0n ~nd Stat~ of Colorado, which was
of the said Hennan C. Haffner, deceased, at the time of his death:
A tract or parcel of land No.6 of Colorado Dept. of Highways I project
No. I 70-3(12)281 containing 43,634 sq. ft.. more or less, in the S~ of Block
20, Berkeley Heights Second Filing of Section 13, Townshi~ 3 South, R~nge
69 West. of the Sixth Principal Meridian, in Jefferson County. Colorado,
said tract or t~rcel being more particuiarly described ~~ follows:
Beginning at a point on the west line of Blork 20, Berkeley Heights
Second Filing in Section 13, T. 3 S., R. 69 W. from which point the SW
corner of Section 13 bears S. 00 05' W. a distance of 340 feet;
