PURSUANT TO ^ COURT ORDER AUTHORIZING TIiE STATE DEPA.RT-

BE IT ORD~lNED BY TH~ CITY COUNCIL OF THE CITY 01' m\El\T RIDGE,
COLORl\DO:
mIEREAS, the State Department of Highways, Division of
Highways, State of Colora~o, by statute possessing the right of
eminent do~ain, has in3tituted a Petition in Condemnation against
the City of Wheat RidiJc i, Civil Action No. BOCV0026 in the
District Court in and for the County of Jefferson, State of
colorado, and
mIEREAS, by Order of Court dated Ja~~J 1980,
Ronald J. Hardesty, District Judge, gran tea r~ght of possession
to the State Department of Hiqhw~ys of ttle property described in
the Above-mentioned petition in Condemnation, and
NOi~, THEREFORE, BE IT RESOLVED by the City Council of the
City of Wheat Ridge, Cclorado:
1. The City Council of the City of \1hcat Ridge, Colorado,
pursuant to Section 16 5 of the Home Rule. Chaxter of the City of
Wheat Ridge, Colorado, do~s hereby
convey, to the State of Co1orndo, State Department of Hiqhways,
pursuant to the Court 0rdcr of January 29, 1980, the following
described real property situate, lying and being in the City of
Wheat Ridge, County of Jefferson, State of Colorado, to-wit:
Each and every right or rights of access to and from
any part of the right of way of Colorado State Highway
No. 76, a freeway established accordinq to the laws of the
State of Colorado, and from and to any part of the real
property in the SE 1/4 of the SW 1/4 of Section 14,
Township 3 South, Range 69 West, of the Sixth Principal
Meridian, in Jefferson County, Colorado, abutting upon
said highway, along or across the accest line or lines
described as follows:
Beginzling at a point on the we5t right-of-way line
of Hansworth Boulevard (June, 197B), from which the
S 1/4 corner of Section 14 bears s. ~]. 14' E., a
distance of 172.2 feet;
1. 1'hcnce N. 4211 49' 45" 'ii a distance of 106.2
fnet to the ~outhcrly right-ai-way line of SH 70
(;rune, 1976).
All bearings used in th~ above description are
oricnt~tcd to the ColoradO Coordinate System Grid
(Cl..ntrlll Zone).

2. Safety Clause. The City Council hereby finds, determines
ana declarcstnat tins ordinance is promulgated under the police
power of the City of Wheat Ri~ge; that it is promulgated for the
health, safety, and welfare vf the public, and that this ordinance
is necessary for the preservation of health and safety for the
protection of public convenience and welfare. The City Council
further detcrmi~es that the ordinanee bears a rational relation
to these objectives.

3. ?~il~. ~f any clause, sentence, paragraph, or
party of this ordInance or th~ ap?lication thereof to ~ny person
or clrcUlnstances shall for any reason be adjuoged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its
#pplication to other persons or circu~stances.

publication.
