WITNESSETH
1. WHEYCAS, the Owner I'; the titled Owner elf a tract of lanj in the City of
Wheat Ridge, County nf Jefferson, State of Colorado, described as follows:
Lot 1 of DeVries Subdivision Recorded in Book 46 Page 33
2. \~iiEREAS, the Owner desires to develop that traLt of land as described ln
rarilgraph No.1, and in fa, , has been issued a SuildinCl Permit to do su,
and
3, WHEREAS, All Street Improvements fronting on Parfet
boarding that--traeXof land as desc\The(f fn Pa'raqraph No.1 and the
nelghborinq tracts of land are incomplete and below those standards as
set out in the SUBDIJISION REGULATIONS of the City; and
4. WHEREAS, to be uniform and consistant with the existing neighboring improve-
ments and comr1etion or non-completion of +-hose improvements as required by
SECTIO~ FiVE: IMPROVEMENTS of the SURDIVISION REGULATIONS wlll make no
silnificant chanqe lt the present in those streets frontinq that tract of
land as described in Daragraph No 1, anrl the neiohborinq tracts of land;

5. \VHEREAS, in order t) c ,nfor!'! to those req:lirements as set out in the SUB-
DIVISION RE(,UUHILJNS of the Citv, thi., iHlreement is hereby determined to

A. The responsibility for meetinq, confo(lllinq to and providinrJ those require-
ments as set out in the SUBDIVISION REGULATI0'JS of the City is hereby
recognized by Owner,
B. The Oirector of PlJbllc Wor~s, upon the advice and consent of the Mayor,
shall direct tile Owner or his assions and successors to meet those require-
onents as set out in the SUBDIVISION REGULATIOilS of the City,
C. Upon l'eceifJt of such notice to furnish or construct the public improvement
as required under the SUBDIVISION REGULATIONS of the City, Owner hereby
agrees to construct and fu,ni,;h *Owner's cust, such improvements as are
required by the SUBDIVISION REGULATIONS of the City, and to do so in con-
formance \~ith the 1esiqn standards of the SUBD~VISlON REGULA.TIONS of the City,
D. In the event an iillprovement d 3trict is created by the City to improve or
provide tnose requiref11ents ilS set ou: in the SUBDIVISIOn REGULATIONS for
those streets or streets frontinq that tract of land as described in
Paragraph No.1 above and the neighboring tracts of lands, the Owner or
his assions and successors agree not to oppose its creation,

F, Upon execution of this DEVELOPMENT AGREEMENT by the City and Owners, the
City will waive the immediate guarantees for public improvements as set
out in the SUBDIVISION REGULATIorJS of the City
G. This agreement is e/ecuted by the Owner pursuant to the SUBDIVISION REGULA-
TIONS of the CITY OF WHE~T RIDGE.
H. The Parties hereto agree that this DEVELOPMENT AGREEMENT, by its terms,
shall be binding upon the City and the Owner, and upon the assigns and
successors thereof; and shall constitute covenants running with the described
property,
This DEVlLOPMlNT AGREEMENT shJll be recorded with the County Clerk and Recorder,
IN WITNESS WHEREOF, the parties have set their hands and seals on the date first
shown,
