Myers herei nafter referred to as-Own-er-, .--- _u_ - ------ ------ \~ ITNESSETH: 2, WHEREAS, the Owner is the titled Owner of a tract of land in the City of Wheat Ridge, County of Jefferson, State of Colora~o. described as fo~lows That part of the SW% of the S~~ of the NE% Section 25, Township 3 South, Range 59 West of the 5th P.M., described as follows: Beginning at a point 40' East and 30' North of the SW corner of the NE% of said Section 25, said point being on the East right-of-way line of Wadsworth Boulevard; thence North along said East right-of-way line of Wadsworth Boulevard a distance of 201.0'; thence East and at right angles to said East right-of-way line of Wadsworth Boulevard a distance of 155.0'; thence South and parallel with said right-of-way line a distance of 201.0'; thence West a distance of 165.0' to the Point ('JHEREAS, the Owner desires to 'ievelop chat t.ralt of land as described in Paragraph No, 1, and in fact., has been issued a Buildirlrj Permit. to do so, and of Begin- ning 1 , 3. Upon execution of this DEVELOPMENT AGREEMENT by the lty and Owners, the City will waive the immediate rjUarantees for public mprovements as set out in the SUBDIVISION REGUL~TIOHS of the (it), G. This agreement is executed by the Owner pursuant to the SUBDIVISION REGULA- TIONS of the CITY OF WHE~T RIDGE. H. The Parties hereto agree that this DEVELOPMENT AGREEMENT, by its terms, shall be binding upon the City and the Owner, and upon the assigns and successors thereof; and shall constitute covenants running with the described property. This DEVELOPMENT AGREEMENT shall be recorded with the County Clerk and Recorder.
