SECTION FIVE' IMPROVEMENTS of the SUBDIVISION R~GULATIONS will make no

NOW, THEREFORE, IT IS HER~LY AGRE~D. THAT,
A. The responsibility for meeting, conforminq to and prOvlolnlj those require-
ments as set out in the SUBDIVISION REGULATIONS of the ritv is herebj
recognized by Owner.
B. The Director of Public Works, U(''''1 the advicE' and consent of the Mayor,
shall direct the Owner 0' his assiljns and successors to meet those require-
ments as set out in the SUBDIVISION REGUL~TIONS of the City
C. Upon receipt of such notice to furnish"r construct the public inlprovement
as required under the SUBDIVISION REGULATIONS of the City, Owner hereby
agrees to construct and furnish at Owner's cost, such improvements as are
required by the SUBDIVISION REGULATIONS of the City, and to do so in con-
formance \'iith the design standards of the SUBDIVISION REGliLI\TIONS of the City.
D, In the event an improvement di stri ct is crea,ted by the r:i ty to improve or
provide those requirements as set out in the SIIBDIVISION REGUl.ATIONS for
those streets or streets frontinlj that t! act of land as described in
Paragraph No.1 above and the neiqhborin~ tracts of lands, the Owner or
his assigns and successors agree not to oppose its creation
E. In the event an impruvernent district is creiJ.ted bl' the City to provide
the improvements as provided by the SU~DIVJSION REGULATIONS, the costs
accessable against the property as d0scribed in Para~raph No.1 shall not
be disoroportionate with costs accessiJ.ole tu other nearby and like nroperties.
