It L\ S91684 County of Jefferson State of C( Recorded IN ~V\ rot t.. \,,26 ,/,80 DEVELOPMENT AGREEMENT THIS DEVELOPMENT AGREEMENT, as authorized by the SUBDIVISION REGULATIONS of the CITY OF I,JHEAT RIDGE, is entered into this 24th day of May 1977, between the City of Wheat Ridqe, a r,luniclPal Corporatlon, hereinafter referred to as City, and _____~Ge9~~ Graul hereinafter referrerl to as Owner WITNESSETH: 1 . \;JHEREAS, the Owner is the titled Owner of a tract of 1 and in the City of \~heat Ridge, County of Jefferson, State of Colorado, described as follows' 3. The North 280 feet of the following parcel: That portion of the ~E 1/4 of the NE 1/4 of the SW 1/4 of Section 23, Township 3 South, Range 69 West of the 6th P. M" Jefferson County, Colorado, which begins at a point which is the intersection of the South line of West 44th Avenue with the East line of Yarrow Street, which point of beginning lies 30 feet South of the North line, and 2S feet East of the West line of said ;,iE 1/4 NE 1/4 SW 1/4 of Section 23 thence South along the East line of said Yarrow Street and parallel with th~ Westline of said NE 1/4 NE 1/4 SW 1/4 a distance of 581,25 feet to a point, thence east and parallel with the South line of said NE 1/4 NE 1/4 SW 1/4 a WHEREAS, the Owner desires to develop that tract of land as described in Paragraph No, 1, and in fact, has been issued a Building Permit to do so, and WHEREAS, ~700 ~~, 44th Avenu~___ __________ boarding that tract of land as described in Paragraph No neighboring tracts of land are incomplete and below those set out in the SUBDIVISION REGULATIONS of the City, and See attached Exhibit HI 2. 1 and the standards as n WHEREAS, to be uniform and consistant with the existing neighboring improve- ments and completion or non-completion of those improvements as required by SECTION FIVE: IMPROVEMENTS of the SUBDIVISION REGULATIONS will make no significant change at the present in those streets fronting that tract of land as described in Paragraph No, 1, and the neighboring tracts of land; and . 5. WHEREAS, in order to conform to those requirements as set out in the SUB- DIVISION REGULATIONS of the City, this agreement is hereby determined to be proper. NOW, THEREFORE, IT IS HEREBY AGREED, THAT, A. The responsibility for meeting, conforming to and providing those require- ments as set out in the SUBDIVISION REGULATIONS of the City is hereby recognized by Owner. B, The Director of Public Works, upon the advice and consent of the Mayor, shall direct the Owner or his assigns and successors to meet those require, ments as set out in the SUBDIVISION REGULATIONS of the City. C. Upon receipt of such notice to furnish or construct the public improvement as required under the SUBDIVISION REGULATIONS of the City, Owner hereby agrees to construct and furnish at Owner's cost, such improvements as are required by the SUBDIVISION REGULATIONS of the City, and to do ~o in con- formance with the design standards of the SUBDIVISION REGULATIONS of the Citv, D. In the event an improvement district is created by the City to improve or provide those requirements as set out in the SUBDIVISION REGULATIONS for those streets or streets fronting that tract of land as described in Paragraph No, 1 above and the neighborinq tracts of lands, the Owner or his assigns and successors agree not to oppose its creation. E. In the event an improve~ent district i5 created by the City to provide the improvements as provided by the SUBDIVISION REGULATIONS, the costs accessable against the property as describe~ in Paragraph No.1 shall not be disproportionate with costs accessable to other nearby and like properties. 3026 ~ .30 3026 291. F. Upon execution of this DEV~LOPMENT AGREEMENT by the City and Owners, the City will waive the in1!!iedlate quarantees for plblic improvements as set out in the SUBDIVISION REGULATIONS of the City, G. Thi s agreement is e;(ecu ted by the Owner pu rsuant to the SIIr:rr V I 5 J ON REGULA- TIONS of the LITY OF WHE'T RIDGE. H. The Parties hereto agree that this DEVELOPMENT AGREEMENT, by its terms, shall be binding upon the City and the Owner, and upon the assigns and successors thereof; and shall (on~titute covenants running with the described property. This DEVELOPMENT AGREEMENT shall be recorded with the County Clerr and Recorder. IN WITNESS WHEREOF, the parties have set their hands and seals on the d]te first shown.
