THIS DEVELOPMENl AGREEMENT, as authorized by the SUBDIVISION REGULATIONS of
the CITY OF ~IHF A T RIDGE, i s en~Hed i nt(j chi, JJL day 0 f November ,
1977, between the City of Wheat Ridqe, a r'~un;ci[J'al Corporatio-n-, herein'after'
re-ferred to as City, and Gilbert Romero, Jean D. Romero, Felix R. Romero,

WITNESSETH:
1. \1HEREAS, thE' OWfiPr is the titled Ovmer of u trCict of land ir the City of
Wheat Ridge, County of Jefferson, St~tc uf Colorudo, described as follows'
See Attached Sheet
2. \mEREAS, the Owner jesire" to develop that U".3ct ofli',nrJ as described in
Paragraph No.1, and in fact, has been issued a Uuiljing Permit to rio ~o,
and
3. WHEREAS, Curb, gutter & sidewalks at 10805 W. 44th Avenue
boai'd i ng thaTTrilctlif"landasdescrTfiecfTn-Pa-r-aqnPhNo,' Tan'd- the-'-
neighborinq tracts ut land are incomplete and below those standards as
set out in the SUBDIVISION REGULATIONS of the City; and
4. WHER[A~, to be uniform and consistant ~ith the existing neighborin~ improve-
ments and completion or non-completion of those improvements as l'equired by
SECTION fIVE: IMPROVEMENTS of the SUBDIVISION REGULATIONS will make no
significant change at the present in those streets frontina that tract of
land as describer! in Pdl'agraph No.1, and the tIf.i,:!lborinq tr,;ct', 0; ldnd;
and
5. \mEREAS, in order tCJ confol'l'l to those Y'~c:uirer::ents as ~et out ill the ,.IB-
DIVISIOn RE'",\JLATIO~lS of the Citv, this il~lreellient is h('reb~' rlete~mined to
be proper.
NOW, THEREFORE, IT IS HERFBY AGREED, THAT:
A. The respcJrlsibility for meeting, conforminq to anj providinq those require-
ments as set out in the SUBDIVISION REGULATIONS of the City is hereby
recognized by OWner.
B. The Cirector of Public works, upon the advi, e and consent of the MaJor,
shall direct the Owner or his assigns and successorS to meet those require-
ments as set out in the SUBDIVISIO~ REGULATIONS of the Cit}.
C. Upon receipt of such IJtice to furnish or construct the public improvement
as required under the SUBDIVISION REGlJLf,~IONS of the City, O\'iilel' hereby
agrees to construct dnd furnish at Owner's cost, such improvements d~ are
required by the SUBDIVISION REGULATd~jS of the City, and to do so in con-
formance with the eJer;igr. standards of the SUBDIVISION REGULATIOnS of the City.
D. In the event an improvement district is created ly the City to improve or
provide those requirements as set out in the SUBDIVlSIt)'1 REGULATIONS for
those streets or s+reets fronting that tract ot land as described In
Paragraph No.1 above and the neiqhborin'l trilcts of lands, the O\,',wr nr
his assigns and successors agree not to oppose its creation.
E. In the event an improvemont district is created by the C'itv t" fll'ovide
the improvements as provlded by the 5UBD1V1SIGN REGULATIONS. the custs

F. Upon execution of this DEVELOPMENT ACREEMENT Ly the City and Owner~, the
City will waive the irnrnediate quarantees fOl' pub:ic improvements ilS set
out in the SUBDIVISIUN REGULATIONS of the City
G. This CllJreement is executed by the Ovmer pursuant to the SUBDIVISJO:, REGULA-
TIONS uf the CITY or WfE~T RIDGE.
H. The Pdrties hereto agree thilL this DEVtLOPMl::NT AGREc}![iH, by its tenns,
shall De binding upon the City Jnd the Uwner, dnd upon the assigns and
successors thereof; ann s"all constitute (OVC%ints runninq with the descrir,pd
property.
This DEVELOPMENT AGREEMENT shall be recorded with the County Clerk and Recorder.
IN WITNESS WHEREOF. the parties have set their hands and seals on the date first
shown.
