The North 125 feet of the East one-half of Lot 11, Cl EXCEPT the West 20 feet and EXCEPT the East 150 feet thereof, un LEES SUBDIVISION, ALSO KNOWN AS 11880 WEST 44TH AVENUE Coun ty of Jefferson> State of Colorado 2. WIl:.RE:.AS, the Owner desires to develop that tract of land as described in Paragraph No.1, and in fact SEE NOTE been issued a Building Permit ( has/has not) as of MDT APPLICABLE to do so and 3 \'IHEREAS, CURB, GUTTER & SIDEWALK boarding that tract of land as described in Paragraph No. 1 and the neiqhboring tracts of land are incomplete and below those standards as set out in the SUBDIVISION REGULATIONS of the City; and 4. WIEREAS, to be uniform and consistent with the existing neighboring improvements and compl etion or non-completion of those improvements as required by SECTION FIVE: IMPROVEMENTS of the SUBDIVISION REGULATIO~S will make no significant change at the present in those streets fronting that tract of land as described in Paragraph No.1, and the neighborin9 trilcts of land; and 5. \,JjIEREi\S, in order to confonn to those requirements as set out in the SUBDIVISION REGULATIONS of the City, this agreement is hereby determined to be proper. Nml, THFREFORE, IT IS HEREBY AGREED, THAT: A. The l'cspol1sibility for meeting, conforming to and providing those requirements as set out in the SUBDIVISION REGULATIONS of the City is herehy recogni zed hy Owner, \", Th'J Director of Public \oJorks, upon the advice and consent of the Mayor, Shilll direct the Ovmer or his assigns and successors to meet those requirements as set out in the SUBDIVISION REGULATIONS of the City. C. 11;"on \'t;ceipt of such notice to furnish or construct the public improvement as rcqui red under the SUBDIVISION REGULATIONS of the City, Owner hereby aqrees to construct and furnish at Owner's cost, such improvements as are requi )'cd by the SUB DI VI S ION REGULATIONS of the City, and to do so in conformance with the design standards of the SUBDIVISION REGULATIONS of the City. D. In the event an Improvement District or a Special Improvement District is created bv the City to improve or provide those requirements as set out in the SUBDIVISION REGULATIONS for those streets or streets fronting that tract of land as described in Paragraph No. 1 above and the neighboring tracts of lands, the Owner or his assigns and successors agree not to oppose its creation. E. In the event an Improvement District is created by the City to provide the improvements as provided by the SUBDIVISION REGULATIONS, the costs assessable against the property as described in Paragraph No. 1 shall not be disproportionate with costs assessable to other nearby and l1ke properties. .:. ... .1: g:l.. ;~' '" "1~01;~;~C~~f thi s DEVELOPMENT AGREEMENT by the Ci ty and Owners, the I')....-- City will waive the immediate guarantees for public improvements as set t1 out in the SUBDIVISION REGULATIONS of the City. G. This aqreement is executed by the owner pursuant to the SUBDIVISION REGULATIONS of the CITY OF WHEAT RIDGE, II The parties hereto aqree that this DEVELOPMENT AGREEMENT, by its terms, shilll be binding upon the City and the Owner, and upon the assigns and successors thereof; and shall constitute covenants runninq with the described property. SPECIAL PROVISIONS AND AGREEMENTS: .. NOTE: STRUCTURE IS ALREADY EXISTING AND IS NOT APPLICABLE TO THIS DEVELOPMENT AGREEMENT, EXISTING STRUCTURE \HLL BE EXPANDED AT A LATER DATE AND A BUILDING PERMIT WILL BE REQUIRED AT THE TIME OF EXPANSION. ., This DEVELOPMENT AGREEMENT shall be recorded with the County Clerk and Recorder.
