WHEREAS, the Party of the First Part represents and warrants that he
owns and has fee simple title to that certain parcel of real estate located
in the City of Wheat Ridge, County of Jefferson, State of Colorado, more
particularly bounded and described as follows:
A tract of land located in the Southwest Quarter (S.W. 1/4), Northeast
Quarter (N.E. 1/4) Section 291 Township 3 South, Range 69 West of the
Sixth Principal Meridian, said tract being a portion of Tract "A" of
Applewood Village-Second Filing as recorded in Jefferson County Plat
Book 22, Page 16, said tract all being located in the City of Wheat
Ridge, County of Jefferson, State of Colorado and being more particularly
described as follows: Beginning at the Center Section 29, Township 3
South, Range 69 West; thence North 89031'12" East along the East-West
centerline Section 291 Township 3 South, Range 69 West a distance of
305.000 feet; thence North 00044'06" West a distance of 40.000 feet to
a point on the Northerly Right-of-Way line of West 32nd Avenue; thence
North 89031'12" East along the Northerly Right-of-Way line of West 32nd
Avenue a distance of 30.000 feet to the Southwesterly corner of tract
"A" I said corner being the true point of beginning; thence North 44023'00"
East along the Westerly line of tract "A"a distance of 258.030 feet;
thence North 53039'36" East a distance of 136.082 feet; thence South
36020'24" East a distance of 27.539 feet; thence South 42002'54" West
a distance of 93.54 feet; thence South 59018'48" West a distance of
51.08 feet; thence South 33052'12" West a distance of 34.54 feet; thence
South 49004' 18" West a distance of 41.72 feet; thence South 57001' 54"
West a distance of 81.36 feet; thence South 44023'06" West a distance of
65.42 feet to a point on the Northerly Right-of-Way line of West 32nd
Avenue; thence South 89031'12" West along the Northerly Right-of-Way line
of West 32nd Avenue a distance of 35.052 feet to the true point of
beginninq. The above described tract of land contains 13655 Square
Feet or 0.314 acres more or less.
WHEREAS, the Party of the Second Part desires to use said property
for cOllstruction of floodway improvements and structures.
NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:
The Party of the First Part does hereby grant, assign, and set over
to the Party of the Second Part a permanent easement to 1]9illtain~e
floodway and floodway improvements located thereon.

Except as herein granted, the Party of the First Part shall contin-
ue to have the full use and enjoyment of the property.
To have and to hold the said easement unto the Party of the Second
Part and unto its successors and assigns forever.
IN WITNESS WHEREOF, the parties hereto have duly executed this
agreement.
