THIS AGREEMENT made in the City of Wheat Ridge, County of Jefferson, ' ,
State of Colorado, on Mall 7 , 1976, by GUY l"i. CARR and
VIRGINIA S. CARR, residing at 3252 Vivian Drive, Parties of the First Part,
and the CITY OF WHEAT RIDGE, a Colorado Municipal Corporation, herein
called Party of the Second Part.
WHEREAS, the Parties of the First Part represent and warrant that
! they own and have fee simple title to that certain parcel of real estate
located in the City of Wheat Ridge, County of Jefferson, State of Colo-
rado, more particularly bounded and described as follows:
A tract of land located in the Southwest Quarter (S.W. ~), Northeast
Quarter (N.E. ~) Section Twenty-nine (29), Township 3 South, Range 59
West of the Sixth Principal Meridian, said tract being a portion of
Lot 38 of Applewood Village-Second Filing as recorded in Jefferson
County Plat Book 22, Page 16, said tract all being located in the City
of Wheat Ridge, County of Jefferson, State of Colorado, and being more
particularly described as follows: Beginning at the Center Section 29,
Township 3 South, Range 59 West; thence North 89031'12" East along the
East-West centerline Section 29, Townshig 3 South, Range 59 West, a
distance of 305.00 feet; thence North DO 44'06" West a distance of
40.00 feet to a point on the Northerly Right-of-Way line of West 32nd
Avenue; thence North 89031'12" East along the Northerly Right-of-Wa~
line of West 32nd Avenue a distance of 30.000 feet; thence North 44 23'00"
East a distance of 176.970 feet to the Southeasterly corner of Lot 38,
Applewood Village-Second Filing; said point being the true point of
beginning; thence North 36020'47" West along the Southerly line of
Lot 38, Applewood Village-Second Filing a distance of 2.413 feet;
thence North 44052144" East a distance of 80.955 feet to a point on
the Nortgerly line of Lot 38, Applewood Village-Second Filing; thence
South 35 20'47" East along the Northerly line of Lot 38, Applewood
Village-Second Filing a distance of 1.705 feet to the Northeasterly
property corner of Lot 38, Applewood Village-Second Filing; thence N

South 44 23'00" West along the Easterly line Lot 38, Applewood Vill\3ge- c;
Second Filing a distance of 81.050 feet to the true point of beginning. ~
The above described tract of land contains 165 square feet or 0.004
acres more or less.

WHEREAS, the Party of the Second Part desires to use said property
for construction of floodway improvements and structures.

NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:
The Parties of the First Part do hereby grant, assign, and set over
to the Party of the Second Part a permanent easement to maintain the
floodway and floodway improvements located thereon.

Except as herein granted, the Parties of the First Part shall con-
tinue to have the full use and enjoyment of the property.
To have and to hold the said easement unto the Party of the Second
Part and unto its successors and assigns forever.
IN WITNESS WHEREOF, the parties hereto have duly executed this
agreement.
