THIS AGREEMENT made in the City of Wheat Ridge, County of Jefferson,
State of Colorado, on Mav 7 , 1975, by EUGENE E. MANNING and
LaDORA I. MANNING, residing at 3222 Vivian Drive, Parties of the First
Part, and the CITY OF WHEAT RIDGE, a Colorado Municipal Corporation,
herein called Party of the Second Part.

~ WHEREAS, the Parties of the First Part represent and warrant
~ they own and have fee simple title to that certain parcel of real
l' ~ocated in the City of Wheat Ridge, County of Jefferson, State of
rado, more particularly bounded and described as follows:
A tract of land located in the Southwest Quarter (S.W.%), Northeast
Quarter (N.E.%) Section Twenty-nine (29), Township 3 South, Range 59
West of the Sixth Principal Meridian, said Tract being a portion of Lot
Thirty-six (35) of Applewood Village-Second Filing as recorded in Jef-
ferson County Plat Book 22, page 15, said Tract all being located in the
City of Wheat Ridge, County of Jefferson, State of Colorado, and being
more particularly described as follows: Beginning at the center Section
29, Township 3 South, Range 59 West, thence North 89031' 12" East along
the East-West centerline Section 29, Township 3 South, Range 59 West, a
distance of 305.00 feet; thence North 00044'05" West a distance of 40.00
feet to a point on the northerly Right-of-Way line of West 32nd Avenue,
said point also being the Southwest corner of Lot 35, Applewood Village-
Second Filing; thence North 89031'12" East along the South line of Lot
35, Applewood Village-Second Filing a distance of 24.451 feet to the
true point of beginning; thence North 44052'44" East a distance of 133.923
feet to a point on the Northerly line of Lot 36 of Applewood Village-
Second Filing; thence South 54001'33" East along the Northerly line of
Lot 35, Applewood Village-Second Filing a distance of 2.939 feet to the
Northeasterly corner Lot 35, Applewood Village-Second Filing; thence
South 44023'00" West along the Easterly line Lot 35, Applewood Village-
Second Filing a distance of 130.970 feet to the Southeasterly corner
Lot 35, Applewood Village-Second Filing, thence South 89031'12" West
along the South line of Lot 35, Applewood Village-Second Filing a dis-
tance of 5.539 feet to the true point of beginning. The above described
tract of land contains 581.434 square feet or 0.013 acres, more or
less.

WHEREAS, the Party of the Second Part desires to use said property
for construction of floodway improvements and structures.
NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:
The Parties of the First Part do hereby grant, assign, and set over
to the Party of the Second Part a permanent easement to maintain the
floodway a_n.d_Il[JogllJaY improvements located thereon.

Except as herein granted, the Parties of the First Part shall con-
tinue to have the full use and enjoyment of the property.
To have and to hold the said easement unto the Party of the Second
Part and unto its successors and assigns forever.
IN WITNESS WHEREOF, the parties hereto have duly executed this
agreement.
