EASEMENT
THIS EASEMENT made and executed this 25th day of April, 1980,
by and between THE CITY OF WHEAT RIDGE, a municipal corporation
(hereinafter referred to as "The City") and FRANKLIN P. DENNING, JR.
(hereinafter referred to as "Denninq").
For Ten Dollars and other good and valuable consideration,
the receipt and sufficiency whereof lS hereby acknowledged, in
hand paid from Denninq to The city, an easement is hereby granted
by The City to Denning to come upon the property described in
Exhibit A, which is attached hereto and expressly made a part
hereof, for the purpose of installing and maintaininq a portable
water pump in the channel of Lena Gulch, which traverses the
property described in Exhibit A.
It is expressly understood
and agreed, however, that this easement shall also entitle Denning
to come upon the property to install and maintain a permanent
pump in the channel of Lena Gulch, but only upon Denning's prior
submission of plans for the desiqn and location of said permanent
pump to The City for its approval, which approval shall not be
unreasonably withheld.
During the term of this easement, Denning shall be solely
responsible for the maintenance of, and risk of lost to, any
pump installed on the described property. Denninq specifically
agrees to indemnify The City from any liability for damaqe to
or damage caused by said pump.

This easement shall be recorded against the property described
in Exhibit A, and shall be binding upon the parties hereto and
their heirs, successors, and assigns.
