BLEVINS THIS AGREEMENT TO CONVEY EASEMENTS is Dade this ("( tAr>, 101- h . '-.l t e Clty of Wheat d:- 5 day of , 1980, between Mary V. Blevins (Grantor) and Ridge (Grantee). WHEREAS, Grantor owns the real property located at 3975 Kipling Street within the City of Wheat Ridge, Colorado, which is legally described in Exhibit A which is attached hereto and made a part hereof; WHEREAS, Grantee is constructing, and will hereafter maintain, certain drainage improvements upon and within Grantor's property which improvements are for the benefit of Grantor and all property owners upon and affected by waters flowing through Lena Gulch; WHEREAS, it is the intent of Grantee to develop and maintain open space, recreational and scenic facilities and opportunities upon and within Grantor's property for the general health, safety and welfare of Grantor and the other citizens of the City of Wheat Ridge; WHEREAS, Grantor's property, or the portions thereof described in Exhibits Band C attached hereto and made a part hereof, are necessary for the construction and maintenance by Grantee of said drainage improvements and said open space facilities; WHEREAS, Grantor and Grantee have agreed upon the following terms and conditions for Grantor's conveyance of easements to Grantee on the property described in Exhibits Band C; NOW, THEREFORE, the parties above named, for themselves, their heirs, successors and assigns, do hereby agree as follows: 1. Grantor agrees to convey to Grantee as permanent easement all of the property contained in the legal description of Exhibit B without exception. 2. Grantor agrees to convey to Grantee as a temporary construction easement for six months the property described above in Exhibit C. \/ 1 lle)~~~~%~IO 3. Grantee agrees to modify the channel configuration c~ Rott through Grantor's property ln such a manner as to allow Grantor ., continued vehicular access to and egress from those buildings presently maintained by Grantor on the property described in Exhibit A. ~ 4. As consideration to Grantor for the grant herein described, Grantee agrees to pay to Grantor, on the date of delivery of the easements described in paragraphs 1 and 2 above, the sum of $729.00. 5.
