KNOW ALL MEN BY THESE PRESENTS, that Denver Shopping Plaza, Ltd., a Washington
Partnership, of Wheat Ridge, Jefferson County, State of Colorado. hereinafter
called the "Grantor", for and in consideration of the sum of Ten Dollars ($10.00)
and other valuable consideration to them in hand paid by the Urban Renewal
Authority, hereinafter called "Authority", grants RIGHT-OF-WAY and EASEMENT on,
along, over and across the following described premises, to-wit:
Lot 1, Time Square Subdivision, Section 23, Township 3 South, Range 69
West, City of Wheat Ridge, County of Jefferson, State of Colorado,
further described as follows:

*** Starting at the Southwest corner of Lot I, East 265 feet, North 10
feet to point of beginning, continuing North 20 feet, West 12 feet,
South 20 feet, thence East 12 feet to the point of beginning,
for the purpose of establishing and maintaining a sidewalk and landscaped
area at the Northeast edge of Wheat Ridge Town Center Park.

Dear Mike:
This letter is to confirm the agreement between Denver Shopping Plaza, Ltd.,
a Washington Partnership, and the Wheat Ridge Urban Renewal Authority to allow
water runoff from the Wheat Ridge Town Center Park to enter an existing storm
drain inlet and cross a portion of the Time Square parking lot, generally
described as that area beginning at the north end of the connector drive
which enters Lot 1 of Time Square Subdivision from the south, and goes
northwesterly approximately 165 feet to a storm drain inlet,
Any unusual debris, silt, or mud which enters Time Square Subdivision as a
result of this drainage, either during construction or upon completion, will
be cleaned and removed at the expense of the Wheat Ridge Urban Renewal Authority,
It is anticipated and planned that a City constructed storm sewer system will
be completed within the next three years which then will intercept said storm
water runoff.
This agreement is to be in force for three years from date shown below.
