EASEMENT .....~,~/ The ADOLPH COORS COMPANY, a Colorado corporation, hereinafter called the "GRANTOR", hereby acknowledges receipt of $10.00 (TEN AND NO/100'S DOLLARS) from the CITY OF WHEAT RIDGE, hereinafter called the ' / "GRANTEE" whose legal address is Wheat Ridge, County of Jefferson, State of Colorado, in consideration'of ) ~ which Grantor grants unto said Grantee, their successors and assigns, a permanent right-of-way and easement for maintenance of a +/-42 inch diameter storm sewer pipe through, under, across and along the premises described herein. The centerline of said +/-42 inch storm sewer is located +/-10 feet West of the East line of the following described premises to wit: A 10 foot wide strip of land being 5 feet wide on either side of a centerline, said centerline being located 10 feet West of the East line of a 30 foot wide strip of land located in the West one-half of Section 21, Township 3 South, Range 69 West of the 6th Principal Meridian, in the City of Wheat Ridge, County of Jefferson, State of Colorado, more particularly described as follows: BEGINNING at the West one-quarter corner of said Section 21, thence North 00 degrees 05 minutes 30 seconds East along the West line of the Northwest 1/4 of Section 21 for a distance of 614.11 feet more or less to a point on the South right-of-way line of West 44th Avenue: thence East along the South right-of-way line of West 44th Avenue for a distance of 30 feet; thence leaving the South right-of-way line of West 44th Avenue on a course Southerly and parallel to the West line of said Section 21 to the Northerly bank of Clear Creek: thence Westerly along the Northerly bank of Clear Creek for a distance of 30 feet more or less, to the West line of said Section 21; thence Northerly along the West line of said Section 21 to the West 1/4 corner of said Section 21 and to the TRUE POINT OF BEGINNING, as shown on attached Exhibit A. Together with the right to enter upon said premises to survey, repair, replace and maintain said +/-42 inch storm sewer line. The Grantor reserves the right to use and occupy said easement for any purpose consistent with the right and privileges granted above. In case of the abandonment of the easement for a period of one year, all right, privilege and interest herein granted shall terminate. The work of maintaining, repairing or replacing said +/-42 inch storm sewer line shall be done in good workmanlike fashion and completed with reasonable diligence. The ground surface along the easement shall be restored to its original level and condition. Grantee shall reasonably and fully cooperate with relocating the easement and any related fixtures and devices thereon, at Grantor's expense, if so requested by Grantor in writing.
