PERMANENT EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that ANNA AMATO whose address
is 3795 Holland st., Wheat Ridge, county of Jefferson, State of
Colorado, hereinafter called the "Grantor" for and in :,3'-7,.;"
consideration of the sum of TEN AND NO/100 DOLLARS ($10.00) and ~
other valuable consideration to her in hand paid by the city of
Wheat Ridge, hereinafter called "city", does hereby give and
grant to said City PERMANENT EASEMENT on, along, over and 1\
across the following described premises to-wit: 1-~
A tract of land lying in the NW 1/4 of Section 27,
Township 3 South, Range 69 West of the 6th Principal
Meridian, city of Wheat Ridge, County of Jefferson, state
of Colorado, described as:
THE WEST 25 FEET OF THE NORTH 5 FEET OF LOT 48, WEST
HORIZON SUBDIVISION, COUNTY OF JEFFERSON, STATE OF
COLORADO.
For the purpose of: Construction and maintenance of a
retaining wall.
subject to the fOllowing terms and conditions:
1. CITY WILL PROVIDE ADEQUATE DRAINAGE ALONG STREET.
2. CITY WILL PROTECT EXISTING RETAINING WALLS.
3. CITY WILL REMOVE AND REPLACE SAID WALL TO MATCH
DRIVEWAY GRADE, SHOULD IT BECOME NECESSARY.
4. CITY WILL MAINTAIN THE SIDEWALKS ON 38th AVE. AS
LONG AS THERE IS AN OFFICIAL CITY SIDEWALK MAIN-
TENANCE POLICY AND FUNDING IN EFFECT.
5. SEE ATTACHED EXHIBIT "A" WHICH IS HEREBY MADE A
PART OF THIS DOCUMENT.
Said tract contains 125 square feet more or less.
Also known by street and number as: 3795 Holland st., Wheat
Ridge, Colorado, 80033.
And the Grantor hereby covenants with the City that she has good
title to the aforedescribed premises and that she has good and
lawful right to grant this easement.

ADDITIONAL TERMS AND CONDITIONS
The city agrees to hold harmless the Grantor(s) from and against
any suit, claim, attorney's fees, loss or damage, including
personal injury or loss of life, which may occur as a result of
negligent construction or maintenance of said sidewalk and
retaining walls by and/or for the City on the property subject to
this easement.
Construction time frame shall be as specified in resolution number
1435 series of 1994 by the Wheat Ridge City Council on November 14,
1994.
