KNOW ALL MEN BY THESE PRESENTS, that Public Storage tnc" whose address is 701 Western Avenue,
Glendale Ca. 91210, hereinafter called the "Grantors" for and in consideration of the sum of $4212.50 (FOUR
THOUSAND TWO HUNDRED TWEL VE DOLLARS AND FIFTY CENTS) and other valuable consideration to them
in hand paid by the City of Wheat Ridge, hereinafter called "Citv" do hereby give and grant to said City
PERMANENT EASEMENT on, along, over and across the following described premises to-wit:
A tract ofland lying in the S.W j4 of Section 13, Township 3 South, Range 69 West of the 6th Principal
Meridian, City of Wheat Ridge, County of Jefferson, State of Colorado, described as.
Commenclllg at the northeast corner of a Parcel ofland that IS platted as West 48th A venue Public Storage
Final Development Plan and Plat, and whIch is recorded at Book 89, Page II of the official records of the
County of Jefferson, State of Cot ora do Thence S OU 12' 47" E along the east line ofsaJd Parcel a distance
of58.32 feet to the True Point ofBeginnlllg. Thence N 30" 38' 16"W a distance of 48 13 feet to the north
line ofthe said Parcel Thence S 550 II' 18" W along the said north lllle a distance of 15 04 feet. Thence
S 300 38' 16" E a distance of 5S 63 feet. Thence N 89044' 26" E a distance of 8.58 feet to the east line
of said Parcel Thence N 0012' 47" W along the saId east line a dIstance of 15 00 feet to the True Point
of Beginnlllg.
NOTE: All bearings are relative to one another and are based on the bearing of the east line ofthe said West
48th Avenue Public Storage Final Development Plan and Plat which bears NO" 12' 47" W This easement is
shown graphically on the attached "Exhibit A" which is hereby made a part of this permanent easement.
F or the purpose of Construction and maintenance of a storm sewer
Subject to the following terms and conditions.
1 The l ity individually and for itsclfonly agrees to indemnifY, defend. and to hold hannless the (irantors from and against
an\ suit. claim. attorney's fees, loss or damage, including personal injory or loss oflife. which may occur as a result of
co-nstruction, operation, r~pair, replacement or maintenance of said storm sewer hy and/or for the City on the property
suhject to this easement.
2. Ur~ntors reserve for themselves and their successors and assigns the right to use the surface of the permanent casement
granted herein for landscaping induding irrigation and any other lawful purpose not inconsistent with the rights of the
