KNOW ALL MEN BY THESE PRESENTS, that Dennis G. Weddingfeld (Trust), whose address is 10865 W. 32"d Ave.,
Wheat Ridge, County of Jefferson, State of Colorado, hereinafter called the "Grantor(S)" for and in consideration of the
sum ofTEN DOLLARS AND NOll 00 ($10.00) and other valuable consideration to him in hand paid by the City of Wheat
Ridge, hereinafter called "Citv", does hereby give and grant to said City PERMANENT EASEMENT on, along, over and
across the following described premises to-wit:
A tract of land lying in the NW 'I. of Section 28, Township 3 South, Range 69 West of the 6th Principal
Meridian, CIty of Wheat Ridge, County of Jefferson, State of Colorado, described as:
Commencing at the Southeast comer of Lot 3, Marvel Minor Subdivision, as recorded in the official records of
said County of Jefferson, State of Colorado, at Reception Number Fl j 56379 Thence along the easterly line of
said Lot 3, Marvel Minor Subdivision, NOOo 19'05"W a distance of 130.68 feet, to the True Point of Beginning.
Thence continuing along the easterly line of said Lot 3, NOOo 19'05"W a distance of 11.32 feet; thence
S890 19'55"W a distance of I 0.00 feet to a point on the westerly line of said Lot 3, thence SOOo 19'05"E a distance
of 11.32 feet; thence N890 19'55"E a distance of 10 00 feet to the True Point of Beginning.
NOTE: All bearings are relative to one another and are based on the bearing of the South line of the NW 1,;

For the purpose of The construction and maintenance of a storm sewer
Subject to the following terms and conditions: To the extent permitted by la\'>, and without waiving any
immunities, protections, or defenses available at common law or under statute, including, without limitation, the
Colorado Governmenta11mrnunities Act, Section 24-10-101, et seq., C.R.S., the City, individually and for itself
only, agrees to hold harmless the Grantor(S) from and against any suit, claim, attorney's fees, loss or damage,
including personal injury or loss of life, which may occur as a result of negligent construction or maintenance
of said storm sewer by and/or for the City on the property subject to this easement.
Said tract contains! 13.2 square f~et more or less

And the Grantor(S) hereby covenant(S) with the City that he has good title to the aforedescribed premises; and that he
has good and lawful right to grant this easement.
