PERMANENT EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that Dean D. Kunz and Slephanie J. Kunz, whose address is 3211 Oak St.,
Wheat Ridge, County of Jefferson, State of Colorado, hereinafter called the "Grantor(S)" for and in consideration of the
sum ofTEN DOLLARS AND NO/lOO ($10 00) and other valuable consideration to them in hand paid by the City of
Wheat Ridge, hereinafter called "Citv", do hereby give and grant to said City PERMANENT EASEMENT on, along, over
and across the following described premises to-wit:
A tract of land lying in the North 1/2 of Section 28, Township 3 South, Range 69 West of the 6th Principal
Meridian, City of Wheat Ridge, County of Jefferson, State of Colorado, described as:
Beginning at the Southwest comer of Lot 28, Distinctive Addresses at Applewood, as recorded in the official
records of said County of Jefferson, State of Colorado, recorded under Reception Number 93161210 Thence
NOo020'26"W along the west line of said Lot 28 a distance of 12000 feet, to the True Point of Beginning. Thence
N890 19'55"E a distance of 4.57 feet; thence N56003'31 "E a distance of 32.76 feet; thence northwesterly 10.05
feet along a curve which has a central angle of 12047'54", and a radius of45 00 feet; thence S56003'31"W a
distance of 28.98 feet; thence S890 19'55"W a distance of 1.53 feet to a point on the west line of said Lot 28,
thence SOo020'26"E a distance of to 00 feet to the True Point of Beginning.
NOTE: All bearings are relative to one another and are based on the bearing of the South line of the NW11,
of said Section 28 being S 890 \9'55" W
For the purpose of. The construction and maintenance of a stonn sewer
Subject to the following tenns and conditions: To the extent pennitted by law, and without waiving any
immunities, protections, or defenses available at common law or under statute, including, without limitation, the
Colorado Govemmentallmmunities Act, Section 24-10-101, et seq., CR.S., the City, individually and for itself
only, agrees to hold hann\ess the Grantor(S) from and against any suit, claim, attorney's fees, loss or damage,
including personal injury or loss of life, which may occur as a result of negligent construction or maintenance
of said stonn sewer by and/or for the City on the property subject to this easement.
Said tract contains 336 7 square feet more or less.
Also known by street and number as: 3211 Oak Street, Wheal Ridge, CO 80033
And the Grantor(S) hereby covenant(S) with the City that they have good title to the aforedescribed premises; and that
they have good and lawful nght to grant this easement.
