KNOW ALL MEN BY THESE PRESENTS, that Robert Allan Fries and Debra Anne Fries, whose address is 10855 W.
32". Ave., Wheat Ridge, County of Jefferson, State of Colorado, hereinafter called the "Grantor(S)" for and in
consideration of the sum ofTEN DOLLARS AND NOli 00 ($1 000) and other valuable consideration to them in hand paid
by the City of Wheat Ridge, hereinafter called "Citv", do hereby give and grant to said City PERMANENT EASEMENT
on, along, over and across the following described premises to-wit:

Meridian, City of Wheat Ridge, County of Jefferson, State of Colorado, described as:
Commencing at the Southeast comer of Lot 2, Marvel Minor Subdivision, as recorded in the official records of
said County of Jefferson, State of Colorado, as recorded at Reception Number F0983793 Thence along the
easterly line of said Lot 2, Marvel Minor, NOO" 19'05"W a distance of I 05.00 feet, to the True Point of Beginning.
Thence continuing along the easterly line of said Lot 2, NOO"19'05"W a distance of 37,00 feet; thence

Subject to the following terms and conditions: To the extent permitted by law, and without waiving any
immunities, protections, or defenses available at common law or under statute, including, without limitation, the
Colorado Govemmentallmmunities Act, Section 24-10-101, et seq., eR.S., the City, individually and for itself
on ly, agrees to hold harmless the Grantor(S) from and against any suit, claim, attomey's fees, loss or damage,
including personal injury or loss of life, which may occur as a result of negligent construction or maintenance
of said by and/or for the City on the property subject to this easement.
Said tract contains 505 0 square feet more or less.

And the Grantor(S) hereby covenant(S) with the CiIy that they have good title to the aforedescribed premises; and that
they have good and lawful right to grant this easement.
