PERMANENT NON-EXCLlISIVE EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that Wheat Ridge Water District, whose address is 6815 W. 38th
Ave., Wheat Ridge, County of Jefferson, State of Colorado 80033, hereinafter called the "Grantor(S)" for and
m consideration of the sum ofTEN AND NOIDOLLARS ($10 00) and other valuable consideratIOn to them m
hand paid by the City of Wheat Ridge, hereinafter called "Citv", does hereby give and grant to said City
PERMANENT EASEMENT on, along, over and across the following described pren1\Ses to-WIt:
A tract ofland lymg m the SE '/4 of Section 23, Township 3 South, Range 69 West of the 6th Principal
Meridian, City of\Vheat Ridge, Coumy of ktTerson, Stme oicoiorado, described as:
Commencing at the Southeast Comer of said Section 23, thence N450 19'43"W a distance of 42.40 feet
to the Southeast comer of Lot 1, Block 1, Withers Subdivision, as recorded in the official records of said
County of Jefferson, State of Colorado, and the True Point of Beginning. Thence on and along the South
line of said Lot 1, S890 38'23"W a distance of 20 00 feet; thence N44 040'17"E a distance of 28.30 feet
to a point on the East line of said Lot 1, said point being on the West Right-of-Way line for Pierce Street;
thence SOoo 17'49"E on and along the East line of said Lot I a distance of 2000 ft:et to the True Pomt
of Beginning.
NOTE: All bearings are relative to one another and are based on the bearing of the East line of the
SE I/. of said Section 23 being N 00017'49" W
Subject to the following terms and conditions: To the extent permitted by law, and Without waivmg any
immunities, protections, or defenses available at common law or under statute, including, without
limitation, the Colorado Governmental Immul11ties Act, Section 24-10-101, et seq., C.R.S., the City,
individually and for itself only, agrees to hold harmless the Grantor(S) from and against any suit, claim,
attorney's fees, loss or damage, mcluding personal injury or loss of life, which may occur as a result of
negligent construction or mamtenance within said Non-ExclusIVe Easeffit:nt by andlor for the City on
the property subject to this easement.
Said tract contains 200 0 square feet more or less.
Also known by street and number as. 6815 W 38'h Ave., Wheat Ridge, CO 80033
And the Grantor(S) hereby covenant(S) with the City that they have good title to the aforedescribed premises;
and that they have good and lawful right to grant this easement.
