KNOW ALL MEN BY THESE PRESENTS, that Luebke Enterprises, LTD, a Colorado limited partnership, of
Jefferson County, State of Colorado, whose legal address is 12163 West 30th Place, Denver, Colorado, 80215,
heremafter called the "Grantors" for and in consideration of the sum of ONE and NO/I00 DOLLARS ($1.00) and
other valuable consideration to them in hand paid by the City of Wheat Ridge, hereinafter called "Citv", do hereby
give and grant, to the extent of the interest reserved to said Grantor (arising from the Grantor's reservation in the
Quit Claim Deed recorded on September 16, 1999 at Reception Number F0944978 in the official records of said

Commencing at a SW Corner of the SE 1/4 of Section 24, thence NOooI6'49"W on and along the West line, a
distance of 1,057 46 feet; thence N89043' 11 "E, a distance of 30.00 feet to East Right -of-Way line of Harlan Street
and the Point of Beginning;
Thence NOooI6'49"W on and along said East Right-of-Way line, a distance of 10.00 feet; thence N89043'11 "E, a
distance of 1 L50 feet; thence SOOo 16'49"E, a distance of I 0.00 feet; thence S89043' 11 "W, a distance of 1 1.50 feet to
the Point of Beginning.

Subject to the following terms and conditions: To the extent permitted by law, and without waiving any immunities,
protections, or defenses available at common law or under statute, including, without limitation, the Colorado
Governmental Immunities Act, Section 24-10-101, et seq., eR.S., the City, individually and for itself only, agrees
to hold harmless the Grantors from and against any suit, claim, attorney's fees, loss or damage, including personal

anci/or fur the City on the property subject to this easement. I
Said tract cuntains 115.00 square feet or 0.0026 acres, more or less.
Also known by street and number as; 4010 Harlan Street, Wheat Ridge, CO 80033
And the Grantors hereby covenant with the City that they have good title to the aforedcscribed premises, and that
they have good and lawful right to grant this easement.
