ORDINANCE NO. 44
Series of 1970
TITLE:- AU ORDINANCE AMEND ORDINANCE NO. :11 BY THE ADDITION OF
A NEW SECTION ESTABLISHING A NEW ZONING DISTRICT AND BY THE REPEAL -
OF CERTAIN PORTIONS OF SAID ORDINANCE ALLOWING SIMILAR USES IN
OTHER ZONING DISTRICTS. -
BE IT ORDAINED BY- THE CITYCOUNCIL OF THE CITY OF WHEAT RIDGE;
COLORADO, THAT:
Section 1. Section 11, At 6: (A-1 AGRICULTURAL ONE
DISTRICT), - -
A. USE REGULATION:
6. Hospitals and sanitariums for mentally
disturbed or defectives or for contagious or__'___'_
infectious diseases.)
is hereby repealed in full.
Section 2. Section 38 as set out herein is,hereby ordained
to provide the following:
Section 38: H-1
Hospital One District
A. USE REGULATION:
No building or land shall be used and no
building shall be hereafter erected,
converted or.Qtructurally altered unless
otherwise provided herein except for one
or more of the following uses, restricted-
however to thQse areas served by public -
water and sewer facilities.
1. Public General Hospitals
2. Private Hospitals.
3. Homes for aged, nursing homes
(but not including facilities for
mentally disturbed or defective _
or for the care of treatment of
animals).
B. HEIGHT REGULATIOIU
No building shall exceed a height of thirty-
five (35) feet.
C. AREA REGULATIONS:
1. AREA AND MINIMUM WIDTH OF-LOT:-
There shall be a minimum lot area of one (1)
acre. The minimum width for the lot shall
be two hundred (200) feet.
2. FRONT YARD. The minimum depth of front
yard shall be thirty (30) feet.
3. SIDE YARD The minimum side-yard shall be
one hundred (100) feet on each side.
D. REAR YARD. The minimum rear yard shall be ten (_10)_
feet. , _ -
Section 3. Section 39 as set-out herein is hereby
ordained to provide the following:
Section 39: H-2
Hospital Two District
A. USE REGULATION:
No building or.land shall be used and.nn building
shall be hereafter erected, converted or
structurally altered unless_atherwise provided
herein except for-one or more of the following
uses, restructed however to those areas served----
by public water and sewer facilities.
1. Public General Hospitals
2. Private Hospitals
3. Hospitals or Sanitariums for mentally
disturbed or defectives.
4. Hospitals or Sanitariums for contagious
or infectious-diseasea.
B.- HEIGHT REGULATION:
No Building shall exceed a height of one hundred and
sixty (160) feet. -
C. AREA REGULATIONS:
1. Area and Minimum'Width of Lat.
There shall=be a minimum lot area-of fifty
(50) acres.
2. FRONT-YARD.' The minimum depth of front yard
shall be fifty (50) feet.
3. SIDE YARD. The minimum aideyard shall be
one hundred (100) feet on each side.
D. REAR YARD. The minimum rear yard.shall be fifty
(50) feet.
Section 4. Effective Date. This ordinance shall-take-
effect and be-in force-five (5) days after publication following
final passage providing it shall have been passed by an affirm-
ative vote of three fourths (3L4) of the members of the City
Council, otherwise, siad ordinance shall take- effect.thirty (30)
days after publication following final passage;
Section 5. Emargsncy_Clause. The provisions of this
ordinance are necessary to the immediate preservation of_the-
public health and safety of the citizens of Wheat Ridge for the
following reasons:

1. No previous ordinance establishing H-1 and H-2
Hospital Districts exists because-.the City having just completed
incorporation August 2D,--1969, has not heretofore passed an ordinance
relating to H-1, and H-2 Hospital Districts...
2. Ordinances-establishing H-1 and H-2 Hospital
Districts are necessary to preserve the public health and safety of
the City of Wheat Ridge.
