AN ORDINANCE VACATING A CERTAIN PART OF A STREET-LOCATED WITHIN ` THE CITY OF WHEAT RIDGE: I.E: VACATING A CERTAIN DESCRIBED-STREET LYING / IN PART OF THE SOUTHWEST ONE-QUARTER (SW /a) OF SECTION 15, TOWNSHIP 3 SOUTH, RANGE 69 WEST OF THE 5IXTH_(6TH) PRINCIPAL-MERIDIAN.. WHEREAS, by a deed recorded in Book 742at page 232 of the Jefferson County Records, a certain street was dedicated to the public; and WHEREAS, the following described street is no longer necessary for use.-by the public; and WHEREAS, said street is-within the limits ofthe City of Wheat Ridge; and WHEREAS no land would, by a vacation of said street be left without an established public road -connecting it- with another_established public road; and WHEREAS, the Wheat Ridge Planning Commission has approvedthe vacation of--said street. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. The following described, street in. the City of. Wheat Ridge, Colorado, be vacated, to wit; The West Fifteen (15) feet-of Block Two._(2), Juchem Garden Place, lying and being in the County of Jefferson, and State of Colorado, as recorded in Deed Book 742 at Page 232 of the Jefferson County Records. And the same is hereby approved and the described street is hereby vacated; provided, however, said vacation shall be-subject to the following conditions and reservations; There is a reserved to the City of Wheat Ridge and to utility owners the continued, use, and right to construct, operate, and maintain sewer, power, telephone, and gas lines is 'said vacated street. Section 2. Emergency Clause.- The provisions of this ordinance _ are necessary to the immediate preservation of the public health and RECEPTION NO„ 87073644 -2- safety of the citizens of the City of.Wheat Ridge for the following reasons: 1. No ordinance has been previously passed relating to the vacation-of this strest.bEcause the City having just completed incor- poration August 20, 1969, has not heretofore.adopted any ordinances vacating this street. - 2. An ordinance.uacating this street is necessary to allow the orderly developmnet of this area. Section 3. and be in forcefive providing it shall h fourths (3/4) of the ordinance shall -take final passage. Effective Date.
