AN ORDINANCE VACATING A CERTAIN PART OF A STREET LOCATED WITHIN THE TFWHEAT DAG5, TOWNSHIP STREET 3 SOUTHI,G RANGE A OF THE SOUTHWEST ONE-QUARTER (SWY4) OF SECTION 15, 69 WEST OF THE SIXTH (6th) PRINCIPAL MERIDIAN. WHEREAS, by a plat recorded in Book '2- at Page `T. of the Jefferson County Records, a certain street was dedicated to the public; and r WHEREAS, the following described street is no longer necessary ❑r use k by the public; and WHEREAS, said street is within the limits of the City of Wheat Ridge; and WHEREAS, no land would, by a vacation of said street be left without an established public road connecting it with another established public road; and WHEREAS, the Wheat Ridge Planning Commission has approved the vacation of said street. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. The following described street in the City of Wheat Ridge, Colorado, be vacated to wit; The East 30 feet of the South 529.82 feet of the North 559.82 feet of the SW Y4 SE 1/4 SW 17/4, Section 15, Township 3 South, Range 69 West of the 6th Principal Meridian, County of Jefferson, State of Colorado. And the same is hereby approved and the described street is hereby vaca- ted; provided, however, said vacation shall be subject to the following conditions and reservations; There is reserved to the City of Wheat Ridge and to utility owners the continued use and right to construct, operate, and maintain sewer, power, telephone, and gas lines in said vacated street. Section 2. Emergency Clause. The provisions of this ordinance are necessary to the immediate preservation of the public health and safety of the citizens of the City of Wheat Ridge for the following reasons: 1. No ordinance has been previously passed relating to the vacation of this street because the City having just completed incorporation August 20, 1969, has not heretofore adopted any ordinances vacating this street. 2. An ordinance vacating this street is necessary to allow the orderly development of this area. Section 3. Effective Date. This ordinance shall take effect and be in force thirty (30) days after publication following final passage.
