TITLE. AN ORDINANCE VACATING A CERTAIN PART OF A STREET LOCATED WITHIN g e
THE CITY OF WHEAT RIDGE: I.E. VACATING A CERTAIN DESCRIBED STREET LYING i
IN PART OF THE SOUTHWEST ONE-QUARTER (SWIA) OF SECTION 15, TOWNSHIP 3
SOUTH, RANGE 69 WEST OF THE SIXTH (6th) PRINCIPAL MERIDIAN.
WHEREAS, by a plat recorded in Book 2 at page 1 of the Jefferson
County Records, a certain street was dedicated to the public; and
WHEREAS, the following described street is no longer necessary.for
use by the public; and
WHEREAS, said street is within the limits of the City of Wheat Ridge;
and
WHEREAS, no land would, by a vacation of said street be left without
an established public road connecting it with another established public
road; and
WHEREAS, the Wheat Ridge Planning Commission has approved the vacation

of said street.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO,
THAT:
Section 1. The following described street in the City of Wheat Ridge,
Colorado, be vacated, to wit;
Beginning at a point on the Northwest (NW) corner, SEA SE%a SW1A
Section 15, Township 3 South, Range 69 West of the 6th Principal
Meridian: Thence South along the West line of the said SEA SEA
SW/o 30 feet to the true point of beginning: Thence South along
West line of said SEA SEY4 SWA 167.94 feet to a point: Thence
East 30 feet to a point on the West line of Block 8, Juchem'S
Carden Place recorded in Book 2, Page 1 of Town Plats Jefferson
County Records:. Thence North 167.94 feet parallel to West line
of said SEY4 SEY4 Slil'/4 to a point an the Northwest (NW) corner of
Block 8, Juchem's Garden Place: Thence West 30 feet to the true
point of beginning.
And the same is hereby approved and the described street is hereby
vacated; provided, however, said vacation shall be subject to the follow-
ing conditions and reservations;
There is reserved to the City of Wheat Ridge and to utility owners
the continued use and right to construct, operate, and maintain sewer,
power, telephone, and gas lines in said vacated street.

Section 2. Emergency Clause. The provisions of this ordinance are
necessary to the immediate preservation of the public health and safety
of the citizens of the City of Wheat Ridge for the following reasons:
1. No ordinance has been previously passed relating to the vacation
of this street because the City having just completed incorporation August
201 1969, has not heretofore adopted any ordinance vacating this street.
2. An ordinance vacating this street is necessary to allow the orderly
development of this area.
Section 3. Effective Date. This ordinance shall take effect and be
in force thirty (30) days after publication following final passage.

reading by a vote of 6 to 0 this 11th of February
