TITLE. AN ORDINANCE VACATING A PORTION OF A STREET LOCATED WITHIN THE CITY OF
WHEAT RIDGE: I.E. VACATING A CERTAIN DESCRIBED STREET LYING WITHIN CHERRY LANE
SUBDIVISION LYING IN PART OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF
THE SOUTHEAST QUARTER OF SECTION 26, TOWNSHIP 3 SOUTH, RANGE 69 WEST OF THE
SIXTH (6th) PRINCIPAL MERIDIAN.
WHEREAS, by a Plat recorded in Book 13 at Page 37 of the Jefferson County C
Records, a portion of land was dedicated to public use for road purposes; and
WHEREAS, the following described street has not been constructed upon and
improved; and
WHEREAS, said street is not utilized by the public; and
WHEREAS, said street is within the limits of the City of Wheat Ridge,
Colorado; and
WHEREAS, the Wheat Ridge Planning Commission has approved the vacation of
said street.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO THAT:
Section 1. The following described portion of street in the City of Wheat
Ridge, Colorado be vacated to wit;
Beginning at a point 659.2 feet West and 30 feet-South of the Northeast
corner of the SEA of Section 26, Township 3 South, Range 69 West of the 6th
Principal Meridian, thence South 168 feet, thence West 25 feet, thence
North 153 feet, thence on an arc of a curve Westerly whose radius is 151
to a point 699.2 feet West and 30 feet South of the Northeast corner of
the SEA of Section 26, thence East 40 feet to the point of beginning.
And the same is hereby approved and the described portion of street is
hereby vacated; provided, however, said vacation shall be subject to the fol-
lowing conditions and reservations:
There is reserved to the City of Wheat Ridge and to utility owners the
continued use and right to construct, operate, and maintain sewer, power,
telephone, and gas lines in any previous easement within the said vacated
portion of street.
Section 2. Effective Date. This ordinance shall take effect and be in
force thirty (30) days after publication following final passage.
INTRODUCED, READ, ADOPTED AND ORDERED PUBLISHED AND POSTED on first reading
by a vote of 6 to 0 this 16th of September A. D. 1971.
