TITLE: AN DRDINANCE-VACATING A CERTAIN PART OF A STREET LOCATED WITHIN THE CITY
OF WHEAT RIDGE -I.E. VACATING A CERTAIN DESCRIBED PORTION OF STREET LYING WITHIN
THE SOUTHWEST QUARTER OF THE NORTHEAST QUARTER OF-SECTION'2Z; TOWNSHIP 3 SOUTH,
RANGE 69 WEST OF THE 6th PRINCIPAL MERIDIAN.
WHEREAS;by a deed recorded in.-Book 1119at Page 497 of the Jefferson County
Records, a certain street was dedicated to the public; and
WHEREAS, the following described portion of street is-no longer, necessary for
use by the public; and
WHEREAS, said street is.within the city limits of.the City of Wheat Ridge; and
WHEREAS, no land would,-by a vacation of said street, be left without an es-
tablished public road connecting it with another established road; and
WHEREAS, the Wheat Ridge Planning Commission has approved the vacation of said
street.
BE IT ORDAINED: BY THE CITY COUNCIL OF THECITY OF-WHEAT.-RIDGE, COLORADO, THAT:
Section 1_. The following described street in the City of Wheat Ridge, Colorado,
be vacated, to wit:
That part of the west half of the Northeast Quarter (WY2 NE/a) of Section 22,
Township 3 South, Range 69 West of the 6th Principal Meridian, described as
follows: Commencing at _a point 1739 feet south and 132D feet east of the
Northwest corner of the Northeast Quarter of Section 22, Township 3 South,
Range 69 West of the 6th P.M., to the true point'of beginning; thence south
540 06130" west along the west line of the parcel 163.66 feet to corner No.
2; thence north 896 40_130" -east to a point which is 56.52 feet east--of No.
2 being ccrnerNo. 3 of this description; thence North 440 51100°- east to _a
point which is 107.48 feet more or less to a point which lies upon-the West
line of the East-Yz of the Northeast Y4 of said Section 22 and which is 20.0
feet south of-the point of beginning; thence in a northeasterly direction
44.73 feet more or less to a poing which is the Northeast corner of Lot 156,
Clearvale Subdivision; thence southwesterly along the South boundary line of
West 46th Avenue, as platted.in the Plat of Clearvale Subdivision, 30.00 feet
more or less to the paint of beginning, County of Jefferson, State of Colorado
And the same is hereby approved and the described street is hereby vacated;
provided, however, said vacation shall be subject to the following conditions and
reservations;
There is reserved to the City of Wheat Ridge and to utility owners the continued
use and rght..to construct,_operate, and maintain sewer, power, water, telephone,
and electric-and-gas lines-in said vacated street.
Section 2. Effective Date: This ordinance shall take effect and be in force
thirty (30) days after publication following final passage.

a vote of 5 to 0 this 26th day of October A.D 1972.
