HomeMy WebLinkAboutOrdinance-1975-0167 - Lease Park Lands near Prospect ParkINTRODUCED BY ALDERMAN Merkl ORDINANCE NO. 167 Series of 1975 TITLE: AN ORDINANCE AUTHORIZING A LONG TERM LEASE OF LAND FOR PUBLIC PARK PURPOSES LYING BETWEEN WEST 44 AVENUE TO THE NORTH AND CLEAR CREEK TO THE SOUTH, IN THE VICINITY OF PROSPECT PARK IN THE CITY OF WHEAT RIDGE, COLORADO. WHEREAS, it is in the best interests of the citizens of this City that needed and satisfactory Parks and Recreation areas and land be obtained by appropriate and economical means; and WHEREAS, Brannan Sand and Gravel Company and Adolph Coors Company have jointly developed a plan designed to satisfy the afore- mentioned objectives; and WHEREAS, Adolph Coors Company has discharged a part of the responsibilities of the aforesaid plan by tendering to this City an offer to lease for a long term ( 23 vears) three (3) parcels of land; and WHEREAS, this Council, on behalf of the City, has accepted the offer, agreeing as consideration to pay Adolph Coors Company one dollar ($1.00) per year lease rent for the parcels; and WHEREAS, this Council, by formal approval of motion, has authorized the Mayor to enter into and execute a lease agreement consistent with the aforementioned provisions; and WHEREAS, Colorado Revised Statutes 1963, 139-88-2, as amended, provides that the acquisition of park land be solemnized by an ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. This ordinance formalizes the Council approved motion authorizing the Mayor to enter into and execute a lease agree- ment with Adolph Coors Company providing for the lease of the parcels of land described in Exhibits "A", "B" and "C" which are attached hereto and made a part hereof by reference, all of which land is located generally between West 44 Avenue to the north and Clear Creek PAGE TWO - Ordinance No. 167 - to the south, in the vicinity of Prospect Park, City of Wheat Ridge, Colorado; and to lease the said parcels of land for a lease price of one dollar ($1.00) per year for twenty-three (23) years. Section 2. Said lands shall be acquired as and for park lands of the City of Wheat Ridge, Colorado, and shall become public park lands of the City of Wheat Ridge, Colorado, upon conveyances thereof to the City. Section 3. Upon lease conveyance to the City pursuant to the terms of said lease agreement, the Mayor is hereby authorized to accept such conveyance on behalf of the City, and the City Clerk is authorized and directed to record such conveyance in the records of Jefferson County, Colorado. Section 4. The Treasurer is hereby authorized and directed to make lease payments when due in accordance with the terms of the contract herein authorized. Section 5. Effective Date: This Ordinance shall become effective thirty (30) days after publication following final passage.
