HomeMy WebLinkAboutOrdinance-1976-0217 - Amend WR Ord 40 - Deleting Specific SectionsINTRODUCED BY COUNCILMAN CAVARRA ORDINANCE NO. 217 Series of 1976 TITLE: AN ORDINANCE AMENDING SECTION IV, SECTION V, AND SECTION XII OF ORDINANCE NO. 40, SERIES OF 1970, BY DELETING PARTS OF SAID SECTIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO THAT: Section I. The amendments hereby adopted are for the purpose of re- moving from Ordinance 40, Series of 1970, sections as they relate to higher pay for special appointments within the Police Department and the filling of vacant positions as controlled by the current ordinance. Section II. Section IV, Ordinance 40, Series of 1970 is amended to read: The Chief of Police, may, from time to time, with the approval of the Mayor, assign not more than three (3) officers in the Classi- fied Service of the rank of Captain or Lieutenant to perform the duties of Division Chiefs, each of whom shall perform such duties so long as his services are satisfactory to the Chief of Police, and the latter shall see fit to continue such assignment. Each officer so assigned shall receive a salary as set by City Council by ordinance. During such period of time as a Captain or Lieutenant shall serve in such capacity, he shall retain and have accrued to him said time as active service in the Police Department and in the Classified Ser- vice thereof, for all purposes in connection with retirement, pen- sion benefits, sick leave, vacation leave, terminal pay, hospitaliza- tion, doctors, surgeons, nurses and medical care when injured in the line of duty, leave of absence when injured in the line of duty, benefits to his wife and dependent children upon death, and all other benefits of the Classified Service of the Police Department in exis- tence at that time, or hereafter provided, other than salary, on the same basis and with the same effect as if during such time he ORDINANCE 217 had remained in active service in the Police Department and in the Classified Service thereof, and the rank which he held in the Classi- fied Service when appointed. Section III. Section V, Ordinance 40, Series of 1970, is amended to read: The Chief of Police may from time to time assign members of the Classified Service holding the rank of Sergeant, Lieutenant or Captain to the Detective Division; each of whom shall perform such duties so long as his services are satisfactory to the Chief of Police and the latter shall see fit to continue such assignment. Section IV. Section XII, Ordinance 40, Series of 1970, is amended to read: The Chief of the Department, with approval of the Mayor, shall annually, at budget time, supply City Council with an organization chart setting forth the number of positions in the Classified Ser- vice which will be necessary to perform the duties assigned to the Department. The City Council shall, in accordance with authority vested in them, determine thereafter the number of positions to be allocated, based upon the budget available to said department. Nothing in this provision shall prevent City Council from creating new positions at any time, as the needs of the respective departments may require; however, any new positions so created shall be filled in accordance with Civil Service Commission requirements and with the terms of this section. All eligible lists, for both original appointment and for pro- motion to positions in the Classified Service of the Department, shall expire after one (1) year, except that in the event a vacancy should exist in the department and the eligible list for that posi- tion is scheduled to expire under the one (1) year limitation, the Civil Service Commission may extend such list for a period not to exceed ninety (90) days. Section V. All remaining sections of Ordinance 40, Series of 1970, shall remain in full force and effect. Section VI. Severability Clause if any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for - 2 - ORDINANCE 217 any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circum- stances. Section VII. Emergency Clause. The provisions of this ordinance are necessary for the preser- vation of the public health and safety of the citizens of Wheat Ridge for the following reasons: (1) The unfilled command positions in the Police Department require prompt action. (2) The effectiveness of the Police Department may be impaired by the non-filling of these positions. Section VIII. Effective Date for this Ordinance. This Ordinance shall take effect and be in force immediately after publication following final passage providing it shall have been passed by an affirmative vote of three-fourths (3/4) of the members of the City Council and has been approved by the Mayor of Wheat Ridge, Colorado. Otherwise, said Ordinance shall take effect thirty (30) days after publication following final passage.
