ORDINANCE NO. 245
SERIES OF 1977
TITLE: AN ORDINANCE DESIGNATED BY THE SHORT TITLE "PROPOSAL
TO SELL REAL PROPERTY LOCATED AT 10900 WEST 44TH
AVENUE, WHEAT RIDGE, COLORADO"; SUBMITTING TO THE
ELECTORS OF THE CITY AT THE NEXT REGULAR ELECTION,
TO BE HELD ON NOVEMBER 1, 1977, A PROPOSAL TO SELL
LOT 1, BLOCK 2, OWENS SUBDIVISION, COUNTY OF JEFFERSON,
STATE OF COLORADO, AT FAIR MARKET VALUE, TERMS, CASH
UPON CLOSING.
WHEREAS, the City Council of the City of Wheat Ridge,
Colorado, has found and determined that upon completion of
the new city complex, the existing Police/Community Development
Building, located at 10900 West 44th Avenue, and being described
as Lot 1, Block 2, Owens Subdivision, County of Jefferson, State
of Colorado, will no longer be used by the City of Wheat Ridge;
and
WHEREAS, upon completion of the new municipal complex,
the existing Police/Community Development Building will be
excess property and unneeded property.
NOW, THEREFORE, be it ordained by the City Council of the
City of Wheat Ridge, Colorado, that:
Section 1. This Ordinance shall be known as and shall be
cited as the "Proposal to Sell Real Property Located at 10900
West 44th Avenue Ordinance".
Section 2. Subject to approval by the electors of the
City of Wheat Ridge, Colorado, the Police/Community Development
Building located at 10900 West 44th Avenue, Wheat Ridge, Colorado,
shall be sold at fair market value; terms, cash upon closing.
Section 3. Pursuant to 31-15-713, C.R.S. 1973, as amended,
there is hereby submitted to the electors of the City of Wheat
Ridge, Colorado, at the next regular election to be held on
November 1, 1977, for their approval or rejection, the proposal
to sell the Police/Community Development Building located at
10900 West 44th Avenue, as follows:
"Upon completion of the Wheat Ridge Municipal
Complex, shall the City of Wheat Ridge sell

the existing Police/Community Development
Building located at 10900 West 44th Avenue,
Wheat Ridge, Colorado, and being described
as Lot 1, Block 2, Owens Subdivision, County
of Jefferson, State of Colorado, at fair
market value; terms, cash upon closing.
FOR THE SALE
AGAINST THE SALE
Section 4. The provisions of the Colorado Municipal Election
Code of 1965, as amended, shall cover the election on the above
proposal.
Section 5. The officers of the City of Wheat Ridge, be and
are hereby authorized and directed to take all action necessary
or appropriate to effectuate the provisions of this Ordinance.
Section 6. The provisions of this Ordinance are necessary
for the immediate preservation of the public health, safety and
welfare of the citizens of Wheat Ridge, Colorado.
Section 7. Effective Date. This Ordinance shall take effect
and be in force 30 days after publication following final passage.
INTRODUCED, READ, PASSED AND ORDERED PUBLISHED on first
reading by a vote of 6 to O, this 8th day of August 1977
READ, ADOPTED AND ORDERED PUBLISHED on second and final
reading by a vote of 6 to 6 this 29th day of August , 1977.
