ORDINANCE NO. 253
Series of 1977
TITLE: AN ORDINANCE AMENDING SECTIONS 9-8 and 9-10(a) OF THE CODE OF LAWS
OF THE CITY OF WHEAT RIDGE, AS ADOPTED AND PASSED IN 1977,
WHICH SECTIONS PERTAIN TO THE DUTY TO REMOVE WEEDS FROM PRIVATE
PROPERTY; ASSESSMENT AND PAYMENT OF WEED REMOVAL COSTS INCURRED
BY THE CITY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO,
THAT:
Section 1. Section 9-8 is amended to read:
(a) It shall be the duty of every owner of an open area, or any tenant
or agent in charge thereof, as that term is herein defined, to cut or cause
to be cut or destroyed all weeds in excess of twelve (12) inches in height
growing thereon and to remove the weeds so cut to some place where refuse
is ordinarily disposed of.
(b) Section 9-8(a) shall not apply to and shall not be construed to
require removal of any weeds from the city owned or leased greenbelt natural
area.
Section 2. Section 9-10(a) is amended to read:
In the event that any owner, tenant, or agent fails to cut or destroy
and remove the weeds from any open area, as that term is herein defined, and
said weeds are cut by order of the Mayor or his designated representative,
the whole cost of cutting such weeds, together with five percent (5%) for
inspection, shall be paid to the City Treasurer within thirty (30) days
following notice of the assessment of such cost given to the owner of such
open area by registered or certified mail.
Section 3. Sections 9-7, 9-9, 9-10(b) and 9-11(a) & (b) of the Code of Laws of
the City of Wheat Ridge, as heretofore enacted, shall remain in full force and
effect.
Section 4. Effective Date. This Ordinance shall take effect thirty (30)
days after publication following final passage.
