HomeMy WebLinkAboutOrdinance-1979-0346INTRODUCED BY COUNCILMEMBER Lewman ORDINANCE NO. 346 Series of 1979 TITLE: AN ORDINANCE AMENDING ORDINANCE NO. 289, SERIES OF 1978, OF THE CODE OF THE CITY OF WHEAT RIDGE, COLORADO, BY THE ADDITION OF SECTION 12-4. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: Section 1. Ordinance No. 289, Series of 1978, of The Code of The City of Wheat Ridge, Colorado, is hereby amended by the addition of the following section: Sec. 12-4. Parking, Storage or Use of Trucks and Recreational Equipment. (a) No driver, owner or operator of any truck, van, truck trailer, truck tractor, tractor trailer combination or road machinery with a curb weight in excess of 9,000 pounds as shown on the vehicle regis- tration shall park or cause to be parked any such vehicle for longer than two hours at any one time on a street or public right-of-way within any zoned residential district, excluding state highways; except that an operator may park said vehicle for a longer period while actually and continuously engaged in loading or unloading and, except that upon a showing of exceptional need, the Chief of Police or his designee may issue a temporary permit not to exceed three (3) days for such parking. (b) No recreational equipment with a curb weight in excess of 9,000 pounds as shown on the vehicle registration shall be parked or stored on any street, highway, roadway or public right-of-way, excluding state highways, within the City for a period in excess of 48 hours within any five-day period unless such vehicle has been issued a temporary permit not to exceed three (3) days by the Chief of Police or his designee, based on a showing of exceptional need. (c) No recreational equipment or any other vehicle shall be used for living, sleeping or house keeping while parked on the streets, public right-of-ways, or public property of this city. (d) No detached non-motorized equipment, including but not limited to trailers and semitrailers, with a curb weight in excess of 9,000 pounds as shown on the vehicle registration, shall be parked on any street, public right-of-way or public property, excluding state high- ways, of the City for longer than two hours. (e) For the purposes of this Ordinance, recreational equipment with a curb weight in excess of 9,000 pounds as shown on the vehicle regis- tration shall include, but not be limited to, boats, boat trailers, travel trailers, trailer coaches, mobile homes, motorized dwellings, tent trailers, recreational trailers, and buses. Detached non-motorized equipment shall include, but not be limited to, any equipment other than that defined as recreational which is not attached to any part of a vehicle. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 3.
