TITLE: AN ORDINANCE PROVIDING FOR THE REZONING OF LAND FROM RESTRICTED
COMMERCIAL (RC) TO PLANNED RESIDENTIAL DEVELOPMENT (PRD) AND
APPROVAL OF A PRELIMINARY DEVELOPMENT PLAN ON PROPERTY LOCATED
AT 3830 OTIS STREET, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON,
STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO,
THAT:
Section 1. Upon application of Ernest B. Fullerton for approval of
rezoning and a Preliminary Development Plan in Wheat Ridge Case
No. WZ-79-4, and upon recommendation for approval from the Wheat Ridge
Planning Commission, and pursuant to findings made based upon testimony
and evidence presented at public hearing before the Wheat Ridge City
Council, Wheat Ridge Maps are hereby amended to exclude from the
Restricted Commercial (RC) and to include with the Planned Residential
Development (PRD) zone district, and to approve the Preliminary
Development Plan for the following described land:
Beginning at the Southwest corner of Section 24, Township 3
South, Range 69 West of the 6th P.M.; thence South89°48'40"
East along the Southerly line of said Section 24, 527.60 feet;
thence North00°11'20"East, 30.00 feet; thence North00°01'40"
East, 147.50 feet to the true point of beginning; thence
continuing North00°01'40"East, 65.00 feet to a point on the
Southerly line of Lot 3, Anel Subdivision; thence North 89°48'40"
West and along the southerly line of said Lot 3, Anel Subdivision
60.00 feet; thence leaving the Southerly line of said Lot 3,
Anel Subdivision South 68°39'13"West, 34.62 feet to a point
again on the Southerly line of said subdivision; thence along the
Southerly line of said Lot 3, Anel Subdivision North 89°50'40"
West, 142.50 feet to a point on the Easterly line of Otis
Street; thence Southerly on a curve to the left and along the
Easterly line of Otis Street an arc distance of 20.94 feet,
said curve having a central angle of 23°59'44" and a radius of
50.00 feet; thence continuing along the Easterly line of Otis
Street South 00001'40"West, 79.36 feet; thence South 89°48'40"
East, 125.00 feet; thence North 00°01'40"East, 47.50 feet; thence
South 89°48'40"East, 114.00 feet to the true point of beginning
County of Jefferson, State of Colorado, Containing 19,370 square
feet or 0.44 acres.
Section 2. This ordinance shall take effect 1.9_ days after final
publication.
INTRODUCED, READ AND ADOPTED on first reading by a vote of 6 to
0 on this 30th day of July , 1979; ordered published in
full in a newspaper of general circulation in the City of Wheat Ridge,
and Public Hearing and consideration on final passage set for
August 20 r 1979, at 7:30o'clock M. in the Council Chambers,
7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED, AND ORDERED PUBLISHED on second and final reading by a
vote of 6 to 0 , this 20thday of August , 1979.
